Recently, I changed my employer who filed new H-1b for me and new H-4 for my family.

INS rejected H-4 because the original H-4 is still valid (original
valid period until 12/04), but INS did not refund fee (2x 140).
My new H-1 is still pending.

"H-1b depends on an employer, and H-4 depends on H-1b holder rather than the employer. However, if H-1 holder is out of status, H-4 holder is out of status too"
