You are not going to beleive this.. IIO called me and said she will approve 485 today

Folks:

It may sound like a joke. But it is true. An IIO called me this evening (1:49 PST), and said she is going to approve my wife's 485. I was caught by surprise and just said thanks... Read on.


This is what happend in essence. I am the primary applicant and I got my approval Dec 30th (even got the Card early this week). Strangely for my wife, it still said 700 days etc., I loged an Service error stating my wife's case that it has been separated and requested CSC to Expeidate her 485 stating it is an "Service Error". Also stated that her I-131 was mailed by TSC to out old address and USPS returned here I-131 to TSC while TSC moved her file to CSC.

I took all the following means to fight this out (Having seen annoying INS works) and

-Wrote to TSC to locate my wife's I-131
- Sent a Service Error Notice to TSC director
- Sent a Service Error Notice to CSC director
- Called and Logged complaint with CSC
- Had attorney initiate an inquiry on my wife's 485.


As a result an IIO called me this afternoon and said she is going to approve my wife's 485 today and I should receive an approval notice in a day or two. The online still shows 700 days.

As always will promptly share any change in online status with this board.

Online Status Changed!!

I guess, I enjoyed the privilege of knoweing about the approval even before online status changed.

My observation with USCIS is make them do the work. My 2nd AP trigged the chain of actions is my guess and I also agree that I was lucky to get appoval bit early.

This case has been approved. On January 22, 2004, an approval notice was mailed. If 14 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please call the National Customer Service Center at (800) 375-5283.
 
That is fantastic! IIO calling and informing you about
the Approval. Hearing for the first time such incident.

Actually I got a call from CSC

from a IIO asking me whether I had received the approval notices of my 485 on my new address (I was quite shocked by this gratitude of BCIS!)

Congratulations! :) Looks like the IIO was correct.

On a side note, usually in India when some official actually calls to inform about a job done, it is assumed that he/she wants some under the table "basksheesh" :). Though I am sure this was not the case here.

Still very pleasant to see a 2002 April case get approved. Interesting how you beat the system, both in TSC and CSC! :)
 
How do you log "service error" ?
Also, how did you request for a service center change? Doesn't that transfer you to the local office instead ?

I assume you moved from TSC area to CSC area ??

Service Error..

Every Service Center has differnet modes of Expediation Request. TSC wants you fiax the request to you.

CSC handles it in a different way. I followed the procedures listed on uscis.gov.

Basically this is what I did

1) I took a copy of my AP which had right address
2) Took a copy of the envelope mailed by TSC which had old address and USPS "Yellow color sticker (used by USPS while forwarding mails)".
3) I wrote to the "Personal Attention of the Director CSC" explanining him the Service error of mailing the Document to old address though they had right address on File (proof the document itself).

4) Also stated that we need the document, blah. blah. blah. A similar erroe should have happend in my wife's case and her AP has been returned by USPS to TSC. In the mean time TSC tranferred out A-file to CSC (based on my old request). so, they whereabout of my wife's I-131 is unknown. So I requested them to expediate her 485 based on Service Error.

I think CSC is happy with my case as the error is due to TSC and started treating my case special.

On your question of tranferring to local office, yes. TSC indeed sent me a transfer notice back in September stating that they are tranferring my case to Tucson, AZ office. But they actually transferred to CSC (may be because we requested such a transfer back in Dec'02 and also CSC processed my I-140).

Expeditious Handling Requests:
Expedited processing will be granted on a case-by-case basis. Expedite requests will be considered under the following criteria:

Extraordinary industry specific circumstances;

When an expedite is determined to be in the best interest of CIS.
Reasons for the expedite request must be stated on the optional expedite work sheet and should include a one page support letter.

Mark the envelope with a red dot and use the street mailing address. Send via bonded courier or other overnight delivery service to addresses noted under "Mailing Your Application/Petition to Us" of this publication. Petitions and supporting documentation should be submitted in duplicate
