I can only see prevention is 5 years. The offense was in 2005, So in the worst case, you husband can reapply in 2010. But wait for the decision now. Very likely he can get approval because as I said such firearm offense is not a CIMT. If he get a denial letter the deninal letter shouls day when he can reapply

Based on what I've read, I thought it was only 3 years if you're married to a US citizen ?

Yes but the applicaton should also be such marriage based. Did your husband
file N400 based on 3 years of married with you as a citizen? If so, I think by law his case should be approved as long as the offense is not deportable.

I hope that's how it was filed. I'm going to look for the docs. We went to a place called Jewish Vocational Services. The woman who filed the application for us consulted with their on-site attorney regarding the charge before submitting the application. I talked to her after the interview and she said she wouldn't have submitted the application if the charge prevented citizenship, that she knew who the IO was, that she was new and her supervisor would review it and all would be well. It's been almost a month and I don't like not knowing. Plus we got that e-mail today that the case was being sent to the local office for an interview, that's what caused me to be so stressed. Guess I'll pray and keep my fingers crossed.
 
I think we all got those e-mails even when we already finished our interviews. I guess those files were due and were about to be past due so they are being checked and updated.

That email means nothing because everyone for whom USCIS once scheduled inyerview and who has no completed oath received that email or have their phone/online status updated as such.

I know that now. Thanks to this forum.It just made me start thinking and stressing. I really want his mom to be able to visit (they won't grant her visitor visa). It would be a lot easier and cheaper for her than for the four of us to go. Plus, the Ceta's burned one of the ranches in their little town and I'm not letting my kids go. My husband's always depressed (and can be a real jerk) around Christmas when we can't afford or don't have the time to go.
I can't tell you how much stress would be relieved if he's approved.

In your case i would hire a lawyer before the interview..i dunno but my gut feeling on cases like this, i would definitely hire a lawyer..just my opinion.

but like i always tell NELSONYIGA..i always pray for all the forumers who wished and hopes that their case should soon be approved..i want everybody here get equal shot for this great nation and provide better future for their families..Godspeed the process to all who were on standing by! keep the faith and always be POSITIVE!
