My Green Card Journey Described in a Great Detail …….

I came to U.S in June 1998 had to switch companies due to bad experiences with GC .I have started working for ABC Services company (U.S Consulting Company) and they filed for Labor in May 2000 (VA/EB-3) and got approval in One Month . My I-140 got approved in 5 Months around Nov 2000 and the Company Attorney is a Crooked Guy and does not talk to Clients and is very procompany oriented wouldn’t even fax the I-140 Receipt .Since the Priority Dates were not Current at that time lost the Hope of ever filing I-485 and the Contract was getting Completed.

I have got Perm offer from a Fortune 100 Company for a Senior Level Position and I have decided to take up the Offer after the hiring Manager promised to start the Green Card Process immediately. I joined the company and the Manager tells me that the Company Policy has changed that I have to work for a minimum of 6 Months before starting the GC Process.
After Six Months of Service the company starts the GC Process but the Paperwork is stuck between the Immigration Specialist (Bureaucracy within the company) and the Corporate Immigration Attorney (Very Big Law Firm in NY) for 4 – 5 Months and never got filed and during this Period LIFE Act came and there were severe backlogs for LC’s.

I have decided to Resign from the Perm Job and search for a Contract on my own as Consultant and after finding a Contract go back to the Old ABC Services company (Economy is in the midst of Recession) and told them about the Contract and ABC Services Company happily took over me back as a employee and the condition was that I would work for them and they would use the already approved I-140 and file my I-485

But since this company would not file my I-485 without me working for them , I had to get my H-1B Transferred to this company and they have filed my H-1 B Transfer (Sept 2001) and based on the H-1B Receipt Notice under AC21 , I have started working for them . .
I –485 RD : Oct 19th 2001 , ND: Nov 30th 2001.


The Plan was that once I have my I-485 filed I would get married and add my spouse name to the 485 , but the turn of events was against me . The H-1B Case was filed under VSC in Sept 2001 and VSC transfers my H-1B Case File to NSC in Nov 2001. NSC Receives the File after 2 Months (Jan 2002) and Sends a RFE out (March 2002) after another two months for Pays stubs and the Attorney replies back with the Documentation (All the Pay stubs) and even after 2 Months after RFE Reply the H-1B was not approved . I start conferencing the Attorney to NSC every 2 Weeks to talk to a IIO , since the Attorney does not have the Time to Redial the NSC Number the Reply always from NSC was that the Case was sent to storage and they are trying to get the H-1b Case file from Storage in Harrisonburg,VA , all this happened because of a Data Entry Error by INS.

After waiting for Ten Months after filing the H-1B Case and not receiving any Decision and running out of options as I had to get married before the Approval of I-485 and need H-1B approval to leave the Country and for H-4 Visa Issuances purposes. The Attorney calls me one fine day and tells me about Premium Processing (Pay $1000.00 and expect Service) . After loosing Peace of Mind and Frustrated with days of Sleepless nights ,I have sent a personal Check for $1000.00 and Attorney Sends the Premium Processing Package to NSC. After One Week NSC Sends a Letter to The Attorney that they have again transferred the H-1 B file to VSC using the FedEx Overnight Delivery with a Tracking Number.
Well Money Really Talks !!!

The Attorney Enquires with Premium Processing VSC if they have received the File from NSC through E-mail and the Officer from VSC PP calls the Attorney’s Office and the whole situation was explained to the INS Officer. The Officer from Premium Processing takes charge of the Situation and gives the address to send the copy of the Attorney H-1B File and send the Documents by Overnight Delivery . The H-1B Case is approved the very next day and after 11 Months H-1B Saga Ends.

In the Mean time in Jan 2002 the 485 sponsoring company changes its name for Rebranding purposes and that would have created serious problems such as I-140 Amendment in case of RFE ….. Luckily I didn’t get one.

I left on a trip to my home country and got married in October 2002 and came back here and to see my 485 case approved on Nov 14th 2002 as per INS Online Status two days later my wife comes here on H-4 Visa , I am in the Process of Applying for her 485 since the Marriage has occurred before the 485 Approval Date under EB Quota…and hired a new Attorney to handle this case.

Let see how things go ………….Life isn’t always a straight road ….. there are a lot of bumps ….. but ultimately we will get there …… Hang On There and Your Turn will come Soon !!!

AOS for spouse

Are you sure that you can apply for AOS for your spouse if she enters the country after the 485 approval.

I might be in a similar situation and I was under the impression that once the 485 is approved, and if my spouse applies for the H4 and enters after that, its is not possible to apply for AOS for her.

As long as you are married before your GC is approved, you can apply for AOS for your spouce.

I spoke to a Couple of Attorney's on this issue and the Reponse was that if the Spouse Enters this Country within a couple of days of 485 Approval she should be covered , though technically she should would be considered out of status for a short period which is up to adjucating officer to make the decision but outright Rejection is not a possibility as 245(k) and 245(i) can be applicable in some cases.
