Hi, everyone, I have got many help from this forum while I was filing I140. And I have an akwark situation and need your help now.
My I140 was approved by TSC in July and then I moved to Boston. My lawyer in Texas continued to file my I485. However, due to their ignorance and carelessness, they filed my I485 to TSC again this November even though they know my moving all along. Once I heard the news, I asked them to withdraw the case and file to VC, but they said TSC might return the case or automatically transfer it. Now I received the TSC receipt notice from lawyer and they state that TSC will automatically transfer my case to VS within 1-2 month. But I doubt that they have just requested TSC to transfer my case.

Now I am worried whether my case would be transfered correctly or it maybe delayed. And I would like to ask you for help.

1. If Vermont Center received my transfer case, will they give me a notice so that I know that my case is in Vermont?

2. Should I just ask my lawyer to withdraw my case and file I485 to Vermont by myself? In this case, should I wait for TSC to notify me that my case has been withdrawn then file new I485 to Vermont?

3. If my lawyer does not want to withdraw the case, can I ask TSC to withdraw the case myself?

4. Now the problem is I don't know whether my lawyer has asked TSC to transfer my case or not, I guess they may notify TSC without leeting me know. If this is the case, should I still withdraw my case or just wait?

Please give me some advice.

----- If they transfer it will be transferred correctly and no need to worry once they transfer they will let your lawyer know about it.

----- I hope TSC will send a notice to your lawyer or you that case has been transferred to VSC

------ Better discuss with lawyer. It is much better to withdraw before filing new I-485 based on same LC and I-140 with different service center

---- yes you can or can take the service of any other lawyer in Boston

----- if the lawyer requests for transfer he should let you know that he sent letter to TSC, you should ask your lawyer before taking any step.

Today I just talked to my lawyer to withdraw my case from Texas and file to Vermont Center. The paralegal told me that we have to write a withdraw letter and wait for the confirmation notice from Texas that the case is withdrawn, then file to Vermont Center along with the notice, and that also would take at least 1-2 month. Otherwise if Vermont Center receives our I485, look at the A number and see another is pending, they will reject the case. I asked whether we can file I485 to Vermont with a letter of explaination and a copy of our withdraw request, she said she will ask the lawyer. I am waiting for her reply. I don't know what to do now. Hope anybody who are more experienced can help me.
