Hi, I hope someone can help me... Recently, my husband and myself sent off our forms and everything else with it that we needed for I-485 package and I-130 package, we didnt check for updated filing fee's and sent the forms off with the previous fee's.. and now ive just checked and noticed the fees are higher, does this mean our case is going to be denied? Is any way i can send off the remainder amount needed without causing a denial or delay?? Help.. Dont know what to do next.........

Don't worry about anything. It will just be sent back to you specifying the wrong filing amount.

Does this mean we will lose the checks we sent in? And have to send the whole money again, or can we just send in the difference thats owing now. My husband will freak if thats $750 down the drain. =/

No, you will get EVERYTHING you sent in back. Cheques included. Just send everything back with a new check. Don't worry about a thing, you didn't loose money, the case won't be denied. You're ok. Just to give you an idea, my application was sent back 3 times.

With the whole processing delay thats been going on, (10 - 12 months for Family-based adjustment of status applications) does this mean im going to have to wait that long just to have them send it back, then re-send it in and have to wait some time again for approval. My medical exam was only good for one month, i think. It said to send the I-693 forms in one month of having the exam done and signed from Dr. =/

Bumblebee, where did you hear that it takes 10-12 months for family based AOS applications? Do you have a reference? This website shows a current average of 4-5 months to interview.

They should send it back to you fairly quickly I think; probably it will arrive, go to through the receipting process, then they will figure out the fees are incorrect, and send it back to you. Should take a couple of weeks. (Although during the extra busy times last year it took up to several months for receipting.)

However, I don't believe there's anything preventing you from sending another complete set right away that has the correct fee. (But someone please correct me if you think this will confuse USCIS.)

Your medical is good for 12 months I believe. Your passport pictures need to be less than a month old.

By the way, awesome user name. And awesome year (of birth?).

It would take approx 20 days to get it in ur hand back if you are in major city or post office area.
Otherwise a couple days more.

Hi, Thanks for the reply Austriacus, Yup i do have a reference, i was reading it on the USCIS webpage, but who knows maybe i read it wrong.. wouldnt be a first.

http://www.uscis.gov/portal/site/us...nnel=54519c7755cb9010VgnVCM10000045f3d6a1RCRD

That link was where i had read it anyhow...

I wonder if i can resend everything in before i get it back, like you had suggested.. i had made copies of everything.. Anyone know?

(And Austriacus glad you like my username, i couldnt think of what to use so just used my xbox gamertag lol. and yes it is my birthyear.)

i would not send anything as u don't want to create a mess at USCIS. They are not that great with papers anyways..

Thanks bunnybugs, yea we will just wait until we get everything back, i was only concerned about going over the month for the medical exam but if thats good for 12 months then i will just be paitent. thanks :)

If it's 12 months, it's a news to me. May be I wasn't aware of it. The civil surgeon in Atlanta told us that the I-693 report would be good for 6 months. It used to be 1 year but now it's been changed to 6 months. Please correct me if I'm wrong.

I-693 is good for a year, but if I-485 is pending longer than that then the validity of the medical is automatically extended. There is a memo on it, if anyone wants to find it.

Hi All,
i probably should of asked this before i had sent off my form, for form I-485 i married a USC, so would i need to answer A or B on Part 2?? Anyone know. I think i had put down B, but now i read in another thread that it should be A.. Just want to clarify?
Thanks.

Yea i guess i didnt read the instructions for that one properly, Thanks Praetorian.
My forms are getting sent back anyway for wrong fee amounts so ill just fix that
question when i get it. Thanks.

It was not aimed at you BumbleBee. Not personally anyways... but it seems the rule and not the exception that people do not download the instructions and read them before filling out forms... That way there would not be any "wrong fees", "wrong address", "wrong answers". Or at least, not as many :p

Its all good Praetorian, i didnt take it personally but it is true, well atleast for that question.. read the instructions for every other form.. just had older versions, so the fees on the forms i have were the amounts i sent in, but i checked to make sure i could still use the forms and i can. I'll be the first to admit we should read instructions more carefully, afterall that is what theyre on their for...
