Wrong dates on EAD Card - ghee/others what to do?

Hi all,

BCIS, living upto its reputation, printed the 03/2003 to 03/2004 dates on my renewed EAD card, instead of the 03/2004 to 03/2005 dates that I had requested. Customer (dis)Service Center says - send it back to NSC and they would fix it and send u the new card.

What is the best option? Anybody had any luck with such corrections - thru NSC/local office? Any good contacting the congressman/senators? I remember gheewalabhai888 had a similar issue... I have till 1st week march on my current EAD..

Wrong dates

atlantabhopali - Hence you long time to use this EAD (Assume this is going to used in March). I would suggest you to write to them to do the correction, which should not be take more time.

I do remember Ghee had similar issue and sent his EAD for correction as well as sent one more new application, I am not sure what happened for his corrections.. Ghee could you please enlighten us...

Anyway good luck and best wishes to get the correction done..

Nothing to really worry about. Make a good color copy and send it back to them for reissue. I think it should be a non-issue. I have never heard of anyone being penalized for what is clearly an error of the INS.
 
I have exactly the same problem.

Called IIO several times and they told me to send back the card with the proof that points towards NSC's mistake. I didn't have my original copy of the form saved to verify that they made the mistake.

I did some research and came to a conclusion that one might never see an outcome of the correction request in these kind of cases (by the time you get something back, it is usually time to request renewal for the next one). I didn't find any success story so far that talks about solved cases at NSC.

I have sent two differect correction requests so far and one new application and I am waiting to hear back (or who knows they may send another card with the same mistake or even go further one year back, 02/2002 - 02/2003)
I haven't tried at the local INS yet. Didn't have time to spend one whole day. If I don't hear anything back in the next two weeks I will go to the local INS.

My suggestion would be try local INS if that is possilbe in your case and send request immediately.
 
My EAD was renewed without any gap in validity for employment authorization i.e. the new EAD starts from the expiry of the current EAD.

However, my wife's EAD was renewed with a gap of 3 months.

current EAD expires on 03/03/04 and
new EAD valid from 06/04/04.

The expiry date is 03/03/05. So I am thinking that the "valid from" date was a typo.

Anybody had any similar experiences?
 
I asked whoever I talked to

the implication of working with non-intentional typos EADs but didn't get any firm answer. I am not sure legally how we want to interpret it. Any analytical thoughts? anyone?
 
Info from Local Office

Finally, I decided to kill a day and visit the local office. The officer that I met with explained the following:

(a) They cannot issue interim EAD as the EAD petition has been approved

(b) I have to send the card back to NSC for correcting the error.

(c) I **can** continue working while NSC fixes the error, and it would **not** be considered unauthorized employment. I double confirmed this and she assured that as it is a service center mistake to put wrong renewal dates on my card, they cannot hold it against me. I asked if she could provide that in writing to which she refused (no such policy). Nonetheless, I jotted down her name and date/time of my inquiry with her for future reference if required.

In light of the information, I am going to send the EAD card back to NSC with a cover letter and something like "EAD CARD - WRONG RENEWAL DATES" on the envelope, and let them take their sweet little time in fixing without worrying about it. Am making color copies before sending it.

ps: Wife's card came in mail today with start date 1 day after the previous card's expiry date.
 
New application online now says it got

approved on Dec 30, 2003. Very likely they will print wrong dates again because I had attached 3 copies of old EAD cards (one of them was with the wrong dates, the most recent one). Officer can easily get panicked to see two lin #s with same approval periods printed on them!
 
Suggestions please

There is a gap in the expiry date of my current EAD and the "valid from" date of my renewed EAD ... (Valid from 1/29/2004 ... shd have been 1/14//2004) ... I sm still on my H1-B visa with my sponsoring employer..... have not used my EAD ... will I have to let BCIS know about the error in renewal dates?

Not unless,
1. your H1-b expires before Jan. 29, 2004, and
2. you plan to use your EAD before then to continue working

In your current situation, there is really no need for an EAD although it can come in handy as insurance should you be laid off or something and want to change jobs.

Thanks Sankrit... my H1-B does not expire until later (June 2004) and if I have to use my EAD I will be sure I start after the new valid from date ...

in TSC 485 someone had same issue . they call BCIS and they asked to send back original keep copy to u, write letter explaing them what happened. and also write to waive the fee.

check the TSC 485 isssue in 5-6th

I would follow what sankrit has

suggested. sending request for corrections usually means no response from NSC so it is a good idea not to get into this if you don't have to.
 
agree with sanskrit and ghee.. as sairam does not needs the EAD right away, it is best not to do anything at this point.

It does make perfect sense to me not to do anything unless I need to take up an employment before the valid from date on my renewed EAD....

I received the EAD

after a month and a half. This was the second application after they screwd up the dates on the first one. This one is off by 2 days. 2/17/04 instead of 2/15/04. I am not going to correct it and leave it as is. Didn' hear a thing for the error correction request.
 
My lawyers got back to me. They were told by some laison officer at BCIS to re-file the EAD renewal application. However, my lawyer is awaiting some other confirmation (refuses to tell me what he is waiting for) before acting on this.

New (renewed) EAD valid from: 06/04/04
 
Corrected EAD Card Received

Hi All,

I had sent my EAD Card for correction in Jan 2004 and received the corrected card this week. The corrected card has dates starting my recently expired card. Finally, USCIS got things right.
