Can anyone help?

I had all my applications I-140 (EB2), I-485, I-131 ready for filling 2 weeks ago and was just waiting on the LC hard copy (it was certified online) so once I got it... I got all signatures and mailed everything...... after I mailed the pakage I found that they have raised the fees $5 for each application.... do u think they will return it back OR ask for the remaining amount?????

Expect to get a letter from the USCIS asking for the additional $5. I filed my case August 31, 2005. My I-140, EAD, and AP all approev in September. Several LUDs and statu changes for I-485. Got letter November 4, 2005 asking for an additional $5 filing fee, EVEN though I filed in August. Will NOT contest, but just pay up the $5 as they are currently adjudicating my case and will give final decision very shortly. No need to pick a fight with USCIS over $5, even though they are wrong to ask me for the $5 due to my filing back in August.

Thanks for ur reply...

But my question is will they send back my application or i will have to pay the difference?..... beacuse if they will send it back i dont know how long it will take... your case is different cuse they just changed the fees on sep 26

They did not send mine back, I just received a letter to pay the $5, but then again I filed in late August and should not even have to deal with the new filing fee. Technically, the USCIS claim they will send applications back that do not include the correct fee. However, since you are in the transition period between the old and new fee they may just send a letter to pay an additional $5. I'm guessing it's a 50-50 chance for each of the two events to happen.

It probably cost them more than $5 to send the notice and process the $5 when it arrives. Not to mention the cost to them when some people rightfully challenge it.
