485 filed before PD current
99% of the time a written decision means that you I-485 was rejected.
If you are EB3-India, then from your information (PD 8/98 and RD 5/01), it seems to me that your I-485 was filed before your PD was current.
For May 01 the PD cutoff date for EB3 India was 7/98. You should\'ve filed I-485 in June 01 when the cutoff dates for EB3-India advanced to Jan 99.
You can appeal or re-file. Re-filing is probably faster as I have heard some horror stories about wait times on appeals. Also refiling will allow you to get another EAD and continue to work.

Go to your earlier Doctor and fill-up in new forms again. When I filed I submitted every thing as I did a new I-485 form. So do submit everything without any connection with your old I-485. Best of luck. Reddy

I have been monitoring Priority dates for the last 4 years. In my own case, I waited 14 months (I-140 was approved in Apr \'00 and I applied I-485 in Jun \'01) as I had to wait for my PD to become current, so I monitored them closely especially when I was close.
PD became current for all the reason for rejection in this case is due to priority date

Hi, Nachos is right. I checked the PDs also now after hearing this case. So please do not confuse and make fear to "sam". He will receive the letter in two to three days. I sincerely suggest Sam, prepare another I-485 ASAP. take it from me. Best of Luck.

As everyone guessed, it was a denial for early filing. My Attorney received Letter from INS today. Back to the pavilion again.
Since it was his mistake, he agreed to refile without any legal fees. But still it cost me one year and lot of tension.
Anyhow wish me best of luck. I think I desperately need it this time. Thanks all of you for sharing your thoughts with me.

Why INS takes this long ?
Sam, good that at least you now know what to do. But why would the INS take this long just to tell that the PD was not right? Can\'t they tell this even before issuing a receipt notice? Does it mean they looked at the application only after an year ? Just curious.....
I am impressed with the accurate early predictions of many of you regarding Sam\'s written decision.

Please let me know what you did for this problem. It also happend to me.. I reapplied without any thing. Some body also "Bab Han" said he also had same problem but he has a solution...please let us know after you talk with him... Thanks a lot..
