Writ of Mandamus - My I-485 is extremely delayed

Hi All,
How r you guys doing. Lately, I have received couple USCIS letters (after calling USCIS so many times). All the letter said was "your i-485 has been extremely delayed, ... due to security check ... " and so on. I am very frustrated, fortunately, I found out about "Writ of Mandamus" from this site, and I asked my lawyer if he can help me to file this law suit, he said he don't help his client to file this kind of lawsuit. This really left me helpless.
I saw couple postings on this site that a lot of good people are helping people like me to file the Writ of Mandamus, may I know if anyone can help me out?
I really appreciate your help.
 
I think it would help, if you provided details such as ur PD, country of origin, also as to when your filed your I 485?

Hi, thanks for your quick reply!
I co filed I-140 and I-485 in Nov, 2004, my I-140 was approved in
March 2005. I did my finger print for I-485 in May, 2005, since then, nothing had happend. Please advice

Thanks for your message, may I know how far did you go on the "Writ of Mandamus", did you ever hear that the USCIS or FBI will back fire to whoever that file Writ of Mandamus against them, such as revoke your legal status in USA? Please keep me posted. I am going to prepare all the draft this weekend. Oh ya, one last question, I co-filed my i-140, i-485 with my spouse (she is my dependant), may I know should we file the "Writ of Mandamus" as one case, or we should file "Writ of Mandamus" seperately as 2 cases.

This isn't a Third World country. We don't do those sorts of thing.

I second you.

Your WOM is for your I-485 (directly), no jurisdiction agency will deny your I-485 due to the lawsuit, but they can deny your I-140 (indirectly).

And then people get fired. Seriously, this sort of thing doesn't happen. Taking revenge upon a WOM filer by yanking their I-140 or I-485 arbitrarily is the kind of thing that makes federal judges very, very angry.

Please recall my previous postings (JUSTICE --> JUST+ICE)
Be ready for that time that the congress limits the number of WoM.
Delay & inefficiency push the nations beyond the third world countries.
 
When it comes down to official staff involved in Immigration Process I bet US is the worst in the world - many of us on this forum would agree that the process of realizing your American Dream (ultimately becoming an American citizen) has somewhat become like striving for your freedom (as you loose it when you start with the process of realizing your American dream). America is land of opportunites but it comes at a price - have to put in atleast 10 years worth of your life into it.

What's Freedom? Freedom from country where you were born?

Looking at quotes of some of forum members..wondering whats the definition of "Freedom"...!!

One can say, I want to get settle in USA...but talkng "Freedom" from the country where you were born shows down fall as a human being.

Even dog have gratitude by wagging his tail when his master serves the loaf of bread. Here are the guys who were born & brought up ( & fed for around 25 years by country where they were born) wants "Freedom"...

Guys reading this: this guy has for no reason falsely accused me of something that I can not ever imagine. Please do not be involved in this unless and until you fully read and understand what is being talked about here.

Don't talk about stuff you don't understand? I can see that you do not understand English. By freedom I am talking strictly about the immigration procedures in US - as to how much time it takes one to become a US Citizen - I have been in US for 6 years and there is still no sign of when I am going to get my Green Card yet.

I am in no way talking about freedom from the country where I was born... I am infact comparing the freedom that I had in home country with what I have to go through over here... it's exactly the opposite of what you are accusing me off... BTW who is your master for whom you are wagging your tail and what are you doing in US - I guess wagging your tail?. Master, Slave, Dog I see where you are coming from.

BTW where in the my message I posted have I mentioned anything about freedom from home country. Even though you totally misinterpreted my message, the irony is you yourself are here in US - instead of serving your master (home country). Keep this attitude and very soon you will be serving your real master....

I never use this kind of language... but just making a point over here about how it feels when the same kind of language is use against you.

Hope you understand English. What I am saying is "I am here to "Settle". My country got freedom in Aug 1947 & enjoy "freedom" by birth. Citizenship gives freedom is your "mindset" problem. Grow mentally man.

When one is on work visa, and there is no job security and if he/she really want to settle in US then he/she will obviously be tensed until they get green card. And because of ever changing USCIS immigration policies/procedures this tension rises as time goes by. It's been 6 years since I had this tension in my head - Every day that passes by I think about when would I get my Green Card so that I can think about other things in life. I know that not everybody thinks like that, and that everyone has different reasons to settle in US, but I was just expressing how painful this process is. I don't know how long you have been in US but believe with time opinion and perception changes. What seems right now might look wrong later. From my perspective no matter what one should not judge/criticize other person's opinion, belief, or his/her feelings - but I guess that's just my perspective.

However, let's not make our waiting process more painful than it already is. So let's truce out. Peace.
 
Green card process should not stall your way of happiness, leading your life...!

I am here from 1992, went back to home country after 6 years and once again came back in 1998. Though I dont have even Green Card (forget about citizenship!) for around 14 years, it did not impacted my way of thinking & daily life. Last 4 years I am on EAD and happy with it.

I dont have any intentions to disturb any way to anyone. I was born free and I (& almighty God - my Master) decides my fullfilment & happiness of life!! GC is one of the event in my (our) life!

I take this Green Card process as....Every game have its own "rules" to play, and one has to play the game with that rules. As we dont have any option to change these "Rules", we have to play this game with their rules.

I will say be happy, enjoy your life..There are beautiful, better things in world other than GC..!!

Well said, I agree every bit of what you announced here, Even anyone has any more questions regarding "USCIS freedom" I would say bring it on. Only the frustated & helpless stuck in an everlasting so called "checks" or "retrogressions" would interpret that for you....

We are lost somewhere in "Freedom for invasions" and "Restrictions for immigration".
