Writ of mandamus and retrogression

Because of the retrogression, does that mean we lost the base to file a writ of mandamus even when the applicant's PD is current again?
 
Why?

Why, no. When PD will become current again and provided there is still a basis for it (like NC is STILL not completed), WOM will be even more justified than now.
 
Slt, are you caught in retrogression too?

I talked to two immigration lawyers, they all think the dates for EB1 and 2 are ridiculous. And they think the government just want to not work for while and sort things out.

Could we still go ahead with the writ of mandamus for NC pending even in October the PD is not going to be available?

No, i am stuck in just NC which is probably the same thing as retrogression...My PD is current.

No, you can't file a lawsuit if your PD is not current. It will be dismissed right away because the immigration benefit you are asking for is clearly unavailable. Thus, there is no basis for the lawsuit.

Always remember all DV lottery WOM lawsuits. Each year they are routinely dismissed on Sept 30, when the DV js
