Worried: TSC date 7 months past my 485 ND

Hello All,

As per TSC's 07/31/05 report, they are processing 485 cases filed on or after 01/04/04. I filed my 485 in Sept 2003 and did my FP in Dec 2003. I did not receive any notice for 2nd FP.

I was not aware of the procedure of calling NSC for change my address when I moved to my current location 18 months back. I just filed AR-11 form. However when I came to know that one has to call NSC for change of address I did that 2 months back. It is possible that TSC officer sent 2nd FP notice to my old address and USPS did not forward it to my new address. Does one's lawyer also receive an FP notice copy ? I've read in this forum that TSC denied a 485 case as the applicant did not repsond to 2nd FP notice.

I called TSC about my case status but they asked me to call after 30 days as USCIS webiste is still showing 8/11/03 as 485 processing date and asked me where did I got the latest date of 4/1/04. When I told her about aila.org she refused to listen to me saying that they go by USCIS processing dates.

I'm worried due to reports of EB2 retrogression in Sept 2005. Even if my lawyer starts a status inquiry through AILA or senator, by the time TSC receives our request and responds to it, EB2 might have been retrogressed.

What are my options now ? Please help.

The only information I can help you with is that my lawyer received the FP notice as well as myself. I sent a letter to TSC (with a copy from ALL my receipts) notifying them of the change of address and saw two LUDs after few days.

My lawyer did not receive a copy when TSC sent me FP1 notice. Does TSC send a copy to your lawyer too ?
 
They passed mine 2 years ago.. and I am still waiting so...it does not matter what is processing date...nothing you can do....other than waiting for your good day to arrive.

I know there is a long line of 02/03 I-485 filers who are still waiting.....

Did you call TSC directly ? Or Did your lawyer try post a status inquiry through AILA or contact your congressman or senator as to why your case is still pedning ?

My lawyer did NOT get FP notice when I did, he got everything else (EAD, Parole, 140 Approval etc) but NOT FP!

That's my fear, if TSC sent FP2 notice only to me to my old address and USPS did not forward it to my new address, then I guess I'm in big trouble.......

The FP notice will be sent to your lawyer.. Don't worry. Since your lawyer
is your representative, all notices - except the green card - will go to him/her.

You can choose to fax TSC about your case and see what they want
to say about it.. Atleast you can draw their attention on your case.

My FP notice was not sent to my lawyer. It was only sent to my address. I am not sure if this was an exception to the rule but I would make sure that TSC has not sent it out to the old address and you haven't gotten it.

In my case, after I requested address change, TSC sent separate notices, both to me and my lawyer. First my lawyer forwarded those notices to me. USPS sent the notices back to the TSC. TSC after noting address change sent me the copy of the notice along with old envelope with USPS yellow sticker that mentions my news address.

Address change should be reported both by AR-11 form and by calling NCS.

So, the conclusion is, there is no guarantee that TSC sends FP notices to BOTH you and your lawyer.

There is no gurantee that you will get the same notices your lawyer will get. As I wrote earlier, TSC sent FP to both of us and interestingly they sent EAD to me not the lawyer.

We and our attorney received our FP2 code 3 notices on weekend.

Attorney's copy has different appointment date and different ASC address (houston ASC) than our notices !!!

TSC truly deserves an award of excellency for being consistently inconsistent !!!
