Working on EAD and H1 for two different jobs

Hi Guys,

Right now i am working on H1 and my 485 is pending.
I got another offer from my ex-client to work 15 hours a
week on a specifis task.
Is it okey to work on EAD for the second job with my ex-client?

What happens if something goes wrong with my 485, can i keep rest of the
three years(I recenly got 3yrs ext beyond 6yrs) on H1?
How will USCIS know that i have used EAD so i am no more in nonimmigrant status?

I would really appriciate your thoughts on this matter.

Your H1b extension is based off pending 485.. If 485 dies your h1b also dies. With the PD in year 2000 you are all set to get GC by OCT 2006.

[ According to old rules at NSC :Your application will become approvable in the next year (OCT 2006) as they reorder the list in Oct.

NSC is now doing preAdjucation now a days .. Wonder if they have changed there ways .. if so Ur approval should come quick. ]


Did RIR labor took more than 5 years for you .. it might be big big wait.

Once you start working on EAD, your H1 will be void and you will need to switch to EAD for your current job also.

What I have read elsewhere is that H1 extension stays valid even if the basis of extension is not there anymore. Doesn't make sense to me also but this is what most of the times I have read on this forum.

Do not know exactly but somewhere from the forms that you fill up for the payroll at the time of your new employment. That is where you mention how you are eligible for work, i.e. H1 or EAD ( or GC etc.)
I would really appriciate your thoughts on this matter.

Since your PD is current, it should not take too long for you to get your GC. See if you can wait for some time to start that 2nd job. Try opening a inquiry by calling USCIS if your ND is past 30 days the published processing date for 485, that may help.

Erics, i think you are right on H1 being valid even though underlying 485 has been denied. Once you obtain the H1 approval there is no connection between 485 and H1B. Guys, please shed some more light on this if we are wrong.
If i use EAD and H1 at the same time(two different jobs), where exactly i may face the problem? When filling taxes? or when replying for a possible RFE?

As it is right now i should get my GC with in 6 months to an year. But if it gets stuck in Namecheck or something, it may take few more years.

Part time second job offer doesn't come very often so i am actually looking out for all the possibilties.

It was actually a long(and expensive) and frustrating wait with my other LC applications. This one is sub labor filed by my company one year before they applied mien. I had total of three LC's from three different states, one was approved In Feb 2006(took around 4 yrs) and other one in Perm, approved in March 2006(took 2 months). Other one is from Delaware and don't know what's going with it.
