Working on an H4

I came here on my wife's H4 on Oct 8th. I thought that I could come here and have a change of status to H1, but as bad luck would have it the cap has been reached. I have previously held an H1 an year ago , but stayed back in India since an year. Now, can I still work on the old I797 form of mine that is valid till 2005?
If I work will it effect my wife's visa status, as she is the one who sponcered my H4.

----- Simple you entred on H4 visa and your I-94 is based on H4 and you canot work being on H4 status
