Working on 1099 on EAD with 485 pending?

Hi,

Needed advice on the following matter.

Off current project & looking for a job. One company I will be working thru is not ready for W2 & asks me to work on 1099.

485 ND: Oct 2001
FP : Mar 2003
2nd EAD valid till Apr 2004.

Are there any pitfalls? Will working on 1099 create issue for my approval?

If he is not willing to work on W2 then go on 1099 ther will not be any problem.Just form a company probably C-Corp but there will lots of overhead as you will be the sole employee of that company. Ask at least 10 -12$ more from the normal rate otherwise you will be looser.Buddy you are lucky got a job in this market.

I guess its not mandatory to open a company to work on 1099.
Only thing is u will have to pay taxes every quarter...
