Working in India while I-485 goes on.

Hello guys,

I had filed for my I-485 in October 2001 and got my EAD and AP. I am waiting for my FP. I was working as a consultant at a client\'s place and got laid off on Dec 31st. The client is planning to set up its development operations in India and wants me to work there (an Indian company) with no guarantee that they would get me back.

Is it safe for me to go to India and work there for about 3 months during this bad time. I am planning to come back within those 3 months or to give my finger prints if I get a notice inbetween.

Please advise....

There might be a problem if you get an RFE for paystubs. If the

Client is not paying you in dollars, then I don\'t think INS will accept the pay check in indian Rupees. IF no RFE, you should be fine.
 
That is not a problem for me

Although my client is going to be paying me in Indian rupees, my consulting company has agreed to pay me the regular salary here for 2 months...That way I will have my pay stubs and will be shown as working for consulting company in India...

I hope this is fine according to what you said in your earlier posting...Please confirm...
 
What after 2 months ? It may take a year for 485 approval

It may take a year for 485 approval. And if you get RFE ( hope not), it will be somewhere around Aug/Sep 2002. And you will be required to produce pay stubs for the months Feb to Aug 2002. (Nowadays, INS asks for 6 months paystubs, looks like from this forum)
