hi
iam a male applicant for vawa petition and i have applied vawa,i485 and i765 all together.i was asked for rfe in march 2012 and after submitting i got primary facie approval.and now recently they have an update in my case for i765 that it is denied and they have sent the notice explaining the reasons.while the other two applications say pending.i have a very true and strong case,i wasnt expecting anything to happen.has it happened to anybody else?is there still any hope for the other two?

You probably made some procedural errors in the filing. The I-765 for a (c)(31) EAD may be filed concurrently with an I-360 for VAWA. The EAD may be issued for a "pending" VAWA I-360.

In the alternative, you can file the I-765 and the I-36O APPROVAL NOTICE with the I-485 for a (c)(9) EAD.

You prematurely filed an I-485 with the I-360 and probably made a procedural error in doing so. Your I-485 should not have been accepted. Your I-360 and I-765 should have been kept together and processed that way.

Your I-765 likely was separated and marked as an application for a (c)(9) EAD based on a pending I-485 BUT there was NO EVIDENCE to support the I-485 filing (NO APPROVAL NOTICE for any kind of visa petition).

IF someone actually assisted you and made such an error, please report them for their incompetence. IF you did this to yourself, you made a mistake to learn from.

i have an attorney and he filed all these together.and he did print (C)9 option on i765,while filing.so what should be done now,?appeall the same explaining or sending prima facie or file a new i765 writing c 31 for the pending vawa?i 485 is on the initial review stage?
