Work in one state, want to file labor from other state - Same Company

Hello friends -

Here is my situation.

My company has offices in Virginia, Kansas and Kentucky. I work in the Virginia office.

Can I file labor from the state of Kansas ? since labor processing time is faster than in Virginia. I know that a lot of employers are doing this, but I need to show some document, website which shows that we are legal to do this. Only then, my HR will allow me to file labor from Kansas. Is it required that both offices have similar positions ?

Any pointers would be reallllyyyyy appreciated.

It may give you some problem, even though it is possible to file your cases where ever your company has offices as forum shopping issue is going on..
 
GC is for future job, so if you company is willing to open a job in Kansas office, you can apply from that location - it may still be subject to NOFs but if your intention (rather your company's intention) is to work from Kansas after GC, you should be able to sail through. It will be a lot easier if there already are similar job positions in Kansas already (you being the first person in that post may ring alarm bells at DOL).

Your best choice is, follow as per attorney/employer. Avoid things which prompts for risks. Goodlucks.
 
I live and work in Maryland and my company's headquarters is in Florida. My lawyer filed my LC from Virginia (6 months faster than Maryland) becuase our company also has a Northern Virginia office. My lawer said that there is no need for me to worry because, LC is for a particular geographic region and that it can be logically argued that the LC should be valid whether I work in Northern Virginia or in my current office in Maryland since both offices are just 35 miles apart and that they are in the same geographic area namely the Metro DC area....My RIR advertisements were placed in The Washington Post newspaper which has the largest circulation in the area.

My labor application was filed from Florida and got approved from Florida though I work in Maryland. I had similar doubts when my case was filed from Florida. My company's headquarter is in Florida and they apply for labor certification from florida only. There shouldn't be any problem, if you file for labor certification from a state where your company has a branch office even though you are working in a different state.
