Hi,

I finished my MS in CS in june 2006 in US. Then I got my H1 recently with a consulting company in Jan 07. I am trying hard to get a entry level job. But its really hard and i am not getting much calls. I am living with my husband in bayarea but I am thinking of finding a job in India and getting one year experience(or more) and then coming back here and join him and starting a job on same h1 that i have right now. (i dont want to go through all new h1 process again)

Please let me know if its possible or not. If it is possible, how. What do i have to do.

You have H1 right now and no pay check? If you continue more than 2 months you are out of status.

Better change your visa status to H4 . Then find a job in India, work for a year come back to US with H4 . Once you get a job then transfer to H1 which will not come under quota.

Go to india get trained is a wise decision in your part.
Do it now and get more confident on your skill, just a year move very fast.

Thanks for the question bayarea02 and thanks for the reply great guru. I have the similar situation. Can you please confirm if H1B can be transferred without being subjected to the Quota?
My wife applied for H1B back in 2001 while we were in US and got it approved for the period 04/06/2001 to 07/25/2003. But she continued to remainon H4 without using H1B. She is in INDIA from Nov 2005 and continued to mantain her H4 status while I maintained my H1B. Can she apply for transfer back to H1B(She has been out of Country for almost 16 months now) for a different company than company who applied for initial H1B after she comes back to US sometime this year? Since she never used H1B, she did not have paystubs. If she can, will she be eligible to 6 years on H1B or remanining 3 years and 9 months.

Any feedback is very much appreciated.
 
I wife is in the same situation, in 2004 company A filed for her H1B (from H4).
The H1 approval came thorugh but was without a I94. So she didn't work.
She had to go to India for some family related emergency. When she return back in 2005 she came back on her H4. Now company B has filed for H1 in 2008 quota.

So if in the lottery system if her case is not choosen can company B file for a H1 again using the old H1 approval.

Or if her petition is picked up in the lottery will it be considered as part of 2008 quota and have to wait till oct to start working.

Please advise.
