From what I have mostly read one cannot use the experience gained at the present employer for the LC with the same employer. But, I see this entry under the FAQ for PERM under item (3).

Does this apply to someone who applies under present RIR as well? The reason that I ask is that I am in the same situation. My LC is for a position that I am using the experienc gained at the same employer, but under a different capacity. I have been with the same employer since I graduated from College. My lawyer says that this should not be a problem, but I would like to know from those who have been in the same situation.
