Work experience or Edu. Qualifications for H1

I am asking this question on behalf of my brother.

My brother is currently working in chennai as Manager - HR and
Projects in a software consulting company.

He has got nearly 3 years of experience in the industry.

He is a B.A. Economics graduate with other diplomas to his credit.

The issue is, his current company is hesitating to do H1B visa, because
of his educational qualifications. They say he must have 16 years of
education and all those stuff. They are skeptical that the INS may
question his edu. qualifications pertaining to his profession.

Is it true?

My question is :

What does the INS consider? Only educational qualifications or they
also consider work experience?

Please advise me.

What is required is 16 years of education which is equivalent to graduation over here or 6 years of work experience. INS is supposed to be very strict on this and your degree should also be in the position you are being sponsored for a job.

I have Education certificates from India. I am presently working in US on H1 and want to go to Canada to get Multiple Entry visa. Are there any problems in getting multiple entry with not having a US degree certificate?
