Hi All

Won Case against my Consulting Company

I had filed a case against my consulting company to DOL (department of labor)
and we won the case ...
it took more than 2 years but finally we won the case . it very encouraging for all

the deprived and miserable H1-b's like me to atlast get some relief

the issues which attribute to file a case in case of h1 -bs are

1) not able to provide LCA
which actually mentions how much u are gonne be paid


2) not able to give I129 , and I797 (original)



The procedure

DOL will assign the case to there local office

investigate

Give there decision

if
Compnay found guilty
DOL will give them notice



You pay nothign from ur pocket

Give more details. Were you employed elsewhere? was the company penalized/blacklisted? Any settlement or just docs were turned over?
 
The Company was fined as a penalty i am not sure if they were blacklisted but one thing is for sure I am really happy about it
The Company is really a slimball

Well it is good that you received justice. But you are not revealing any useful information here. I can understand whne you dont want to give out the company name or the city/state involved. Atleast give some details as to what was the dispute, what were the hardship faced by you, how difficult it was to move things legally and what did the judge find?
 
Long Story

I was with this consulting Company(B = BAD Company) ... joined it cause there was no other go as they were offering me a project at taht time and my visa with the previous company(A =SEMI OK COMPANY) was close to gettin expired and the first company was not ready to extend my visa

went to client place on the day I started to work for the consutling company ( had negotiated my salary and other things like not being paid on bench and stuff like taht ) .Non of the negotations were in Black and white ...


back ground process that i was not aware of

1) filed H1 only after i came offf the first project (after a month and half)
2)irregular generation of payroll (xcuse --- We have to check with our payroll company as to what exactly the problem was and get back which they never did )

3)not providing me with H1 papers (LCA .. I129 )

4) the moment I got of the project sending a notice to INS askin them to cancel my H1(general practice )

not that as if the compnay was a goldmine every company if they cannot afford the consultant lays him off but u can always file with some other company

without informing it

so i was sitting there in the office all the time thinking that i was on there h1 .. but not knowing how Stupid i was

just got a little suspucios cause my visa had expired and wanted to send to St lousi to get it stamped ..

Company not giving me the required papers

cheked online www.ins.gov witht he WAC #
everythihg looked ok ... (apparently it takes INS atleast couple of months to actually terminate the H1) Thank god for that

kept on checking the ins site and one fine day got the jolt

this h1 has been revoked bla bla date

Complaied to DOL about the company ..

DOL found out wrong doing on the Consulting company part

1) h1 797 - LCA -I129 not given to the respective persons

2) improper pay roll generation (very erratic )

DOL had there own investigations found out consulting company flouting the above 2 voliations ...

Ruled that consulting company has to pay some penalty and some money to us ..

Consulting company had 30 days either
to pay the penalty + paltry sum

OR

go to Court

Consulting company went to court

and it took like a year for the case to come to conclusion

and that is the story

DUDE ... MAJBORRI KA NAM GANDHI JI

I am the last person to resort to such activities but yes We(consultants) have to show the Consulting companies that they are not doing us favors by getting here to the US .. Treating us shabbily some one had to take a Stand and STAND UP for there rights .. nobody is going to fight for your cause you have to fight for yourself
