It is decided in the first instance by the judge. Then an appeal can be filed with the BIA. If this fails then you can ask a federal court of appeals to review the case. After that it is the end (in theory you can ask for Supreme Court review but they do not look at it 99% of the time).
If i were to file it with the Supreme Court, how long would it take for supreme court to respond because i have already filed it with federal court of appeals. how long does the federal court of appeals take anyway?
