Hi,

I am posting this question for my friend.

I am currently working for Company A, i have my LC and I-140 approved. I know i am eligible for 3 year H1 extension. At this point if i join Company B, can Employer A withdraw my approved I-140 and substitute my LC to somebody else? Is this possible?

If i start my new LC via PERM process, how can i retain my PD of my approved LC through Company A?

What kind of documents i need to collect from Company A to get the PD of my approved LC from company A?

I assume your 485 is not filed yet. Yes, employer A can withdraw you approved 140 and substitute for somebody else.

Your PERM gets approved, then your new 140 gets approved and if by that time your old 140 is still valid (not withdrawn or revoked) then you can transfer the PD to new 140.

I am not sure what documents you need, but I would guess a copy of approved old 140. Search this forum or internet for 'Pearson memo' and read it.
