withdrawing and refiling I-140

My lawyer filed my I-140 application in EB3 instead of EB2 by mistake. She is now withdrawing the application and is planning to refile in EB2. I was wondering if anyone had such experience and if there are any gotchas or anything to worry about.

My lawyer did something similar,he put EB3 on the covering letter.
Fortunately VSC has taken it as EB2 as the form was actually filled as EB2.My I-140 is not yet adjudicated,but the 797 shows it is recieved on file as EB2.
So if the forms were filled as Eb3,it may have to be resubmitted as EB2.

I mayy need to file I-140 soon. May I know on the form "exactly" what/where
should I/Employer key-in to say that it is for EB2 ?

Hi,
Please help me in my case.
After LC is cleared from TX, my previous lawyer filed I-140 from TX. When INS introduced concurrent filling, he filled I-140 and I-485 from Vermont. (I was not aware of filing I-140 from Vermont, he didn’t inform me). My Vermont I-140 is approved. But recently I got query for my TX I-140 after 3 years. Query says ‘This petition has been misplaced and has to be reconstructed. Please submit a copy of all the documents again.”
My questions are…
1. Can I ignore that query without giving any reply? (Because my new lawyer is asking $1500 to answer the query).
2. Does any body know the procedure to withdrew I-140 application?
3. Can I hire any other lawyer to answer this one query?
Please help me with your suggestions. Thanks to you all in advance.
