Withdrawal of approved I30

  1. You do not need any official documents. Write a letter to USCIS stating you are withdrawing your I130 petition, get it notarized, and you can make an INFOPASS appointment if you want to deliver it in person.
  2. You cannot file another petition for another woman unless you get divorced otherwise you will be charged with fraud.
  3. Unfortunately you will have to get divorced in the country in which you got married and get documented evidence of it, no way around it.



I am naturalized US citizen (since Sept 2011) married to a my native country girl since Dec 2008. She is leaving in her native country. I have filed a pettition for my wife which has already been approved and USCIS has already advised me to apply visa for my wife to National Visa Centre. Unfortunate due to some misunderstanding we have decided not to live together. Now we are completely out of contact. She is not willing to stay with me or want to diviorce official either. But unformally or socially we are already separated. So I would like to withdraw my pettition. I would appricate if someone could advise me on the follwing question:
1. What are the documents I need to withdraw my pettition
2. If I get married with another lady, how can i file pettion for the new one. Is this possible if I dont have any divorce paper.
3. I can file a divorce in my native country, but due to the law their it may take many years to get separated officially.
Any feedback on those question would be higly appreciated.

  • Unfortunately you will have to get divorced in the country in which you got married and get documented evidence of it, no way around it.
This is false. It is possible to get divorced through a US court even if the marriage took place outside the US.
