When I filed my N400 application, my husband I had a good relationship, then after filing, things went down hill, he went to drug rehab, and moved back to where his mom lives. I still went to the scheduled interview. the officer asked why he doesn't live with me, so I just told her he is undergoing a drug and alcohol rehab program, she asked me to submit more documents for approval. At this point, my husband is not willing to cooperate, and I know the application will be denied, can I withdraw my application at this point? I am not sure if it is too late to withdraw since I already went to interview, now at the time they are asking for more documents. Or should I just wait and not submit anything and wait for them to deny, I don't know if I can reapply if they deny under this situation.

Please help me, thank you guys.

It is very hard to say what is the best way to withdraw. Is your N-400 application is based on your marrige to your "I am assuming" US citizen husband? If that is the case and you been qualified to apply for your N-400 after 36 months from USCIS approval of your I-485, then you should withdraw you application. If that is not the case, then your marrige status has no impact on your N-400. Regardless, your husband can not withold information that is vital for your application.
Best of luck

I dont understand why you want to withfraw the application. Can't you get as his wife, an statement from his mother or doctor?

If they are not "living happily together" and have for all purposes are living separte lives, she would not be eligible to file under the 3 year married and living with a US Citizen husband category.

Currygal - getting denied for this application has nothing to do with a re-application. If you are unable to submit the application they will deny your application for sure. You can reapply in 2 years under the 5 year rule.

Thank you, brb2, thank you everyone, it helps a lot, I really appreciate all the suggestion.

Husband's mom is a very racist and close-minded woman, she always doesn't like the fact her son married a little chinese girl, and very very against me. because the office requested a letter from his mom to prove all these, which is even impossible to get it. So I just have to give up.

I am worried about if i don't submit the info, then the officer will think i am lying.

thank you again, guys.

Be honest with the officer. Tell them your situation. You have reached all the way to the interview, I think it would a shame to have come this long only to give up because of a husband that really doesn't care.

It is true that you have to satify the 'living' conditions but talk to USCIS about it and see what they have to say. Despite everything, you're still married to him and qualified under the 3 yr rule. Hold on tight. Please keep us informed and good luck :)

You still his wife, i guess u have the right to ask his doctor about his profile.. dont give up ur application all you need to do is provide what IO needs from your case..gudz luckz
