Hello All,
I am very new to this site. I have following question.
My GC application is going on.

I got Substitue LC for my GC from my compnay. So I applied for I140 and I485 together.

Notice date for my I485 is oct 1 2002 and received date is sep 20 2002. I have got my EAD. FP is also donw.
I140 notice date is sep 9 2002.
I want to know in this mkt how long I need to be with this company so as even if companies has cutoff and if they remove me my GC application remains uneffected.

Immediate reply will be apprciated !!

Thanks!

When i switch company after my 183 days, what should i file with INS? Just a letter stating my new company name should be enough or should i get a letter from my company too?

You don't have to file anything when you change jobs after 183 days. You should file only if the company itself changes its address or you change your address.

Hi All,
Thanks for prompt reply.
As my I485 RD is sep 09 2002, As per your info I need to be with same comp atleast till March 20 2003. Good , Not very far.
Ok and if situation arises that after March 20 2003 I have to change company, Waht all should I collect from exsisting company and what all I need to handover to new comp lawyer,
Do I need to take care of any procedure with INS individually ( not concern to old and new company lawyer ) ?

Any one of you had anticipitated such situation, Please let me know your contact details I would prefer to talk in person.

Thanks,

You have to be with the Company for at least 180 days from RD of your 485.

Where in AC21, or anywhere in EB immigration, does it state that you must work for your sponsoring employer for even a single day prior to the GC approval?

Based on Murthy's site

Question 10 : How do I exercise the portability provisions? What do I actually have to do? TOP

AC21 does not state that notification to INS is required. The current INS guidance on the issue says that it is "expected" that a letter will be sent to INS. There is also no particular format for sending a letter advising of the change in jobs.

This means, we indeed need to send a letter to INS. Now, do we need a letter from new employer to verify that the new job desciption is same or similar?
