Will Spouse PR Application affect B2/H1 visa application?

Hi all,

My wife is a Green Card holder and works in US. She plans to file an application to get Green Card for me. During this process (from submit date to approval date), could I still apply for B2 or H1 Visa?

I really appreciate any help from you. Many thanks.

Yes, you could still apply. For the B2 you will have to provide good proof that you will return to your home country, and don't plan to adjust status while there. It may be harder to get. For the H1 there is no such issue.

Getting a B2 visa will be difficult because you're married to a green card holder, but being married to a green card holder or US citizen is not a problem for H1B.

But for H1B you may have bigger problems, like the fact that the annual H1B quota already got filled last month.
