Will my spouse case be transferred ? Advice needed Urgently

Hi ,

I work in the San Jose bay area and my I485 has been filed with CSC. Both myself and my wife have EAD's. My H1 expired on June 20 2003 and I have currently applied for an extension. Meanwhile my wife has a job offer in North Carolina i.e. Raleigh. My question is if my wife takes that position and moves there for sometime, will her I485 be transferred to the respective Service Center and Local Office. Also if we donot inform BCIS, are there any risks.

Assuming that your wife is the principal applicant :
if your wife does not get an RFE then you can just keep quiet, get appoved and stamped..however if she gets a EVL/Paystubs rfe which is very very likely, it might point to the fact that her job is no longer under CSC..so it will be better if you inform the INS.

On the other hand, if you are the primary applicant..you wife could work anywhere/any job/any salary on the EAD , no questions asked at all.

Samething happened to us. On July 15 my wife's case transferred to local INS in Tucson, AZ. And I am the principal applicant.

Do u mean to say that your wife's case was transferred to Tuscon. So where did you originally apply and was only her case transferred. I understand that you are the original applicant.
