Hi,

1. I was arrested, finger printed and had mug shots for a misdemenor which is a CMIT for immigration.

2. After 21 days, the court dismissed my case 'Dismissed for lack of evidence'

3. After 7 days, Judge granted the expungement

4. All records have been expunged

5. DId FBI check. Returned 'No Arrest records' found.

6. Did BCI check ( state ) , returned 'No Arrest Records' found.

7. No records in court or local sheriff...

8. Mentioned 'Yes' in I485 for If I was arrested.

9. I have the certified copies of court and police report

My question:

Will I be called for an interview for I485 ?

Most likely

Thanks

Thanks Manny.

What would be the reason to call me for an interview when

1. National Background check
2. FBI finger printing check
3. FBI first name/lastname, lasname/firstname, SSN# check
4. Attempted with a local senetor to do background/fbi checking as if they did background checking for federal/law enforcement officer recruitment

All returned with 'No records found'.

Is that because I checked 'Yes' in the application for if I was arrested?. Or any other reasons to think of?

AsktheQuestion,

I have a question for you, how did you find out that your national background check, fbi finger print check and some of other checks that you have indicated in your post actually retured with 'No Records Found'?

Is there any mechanisum through which we can obtain this information for our cases?

Thanks

Yes. Its because you clicked yes. However, it better to tell the truth... if somehow they found out, you can forget living in this country... ever! So you did the right thing... However, the IO will want to talk to you and check all the evidence etc... Dont worry you should be fine... just take all the papers... and tell the truth!

Hi Waitingforcard,

Yes Judge granted me expungement.
I followed a one of neighbours's instructions who is an employee at courthouse.

The background cheks happened in the below order.

A). Went to downown court and gave my finger prints for correctional department for the below.

1. National Background check
2. FBI check

After 26 days ( with expedition), I got the results for my finger prints saying 'No records found'.

However I was not conviced and hence

B). Went to local FBI field office and requested them to run my check using Social security card. They gave me a printout which says no arrest records found....

C) however after visiting some forums where many people informed that FBI will never erase my finger prints blah blah..So I was still not convinced by myself. Again went to FBI local office to run my details as if they are running for a federal/law enforncement recrutiment application where I heard that they search very deeply. They simple rejected my request and told me that I was asking more details which I was not supposed to ask them...lol...

D)Still, However I was not very convinced. Talked to my uncle here. He and myself took an apointment with local senetor. After explaning everything to her , she wrote a letter to show it to local FBI field office. FBI local office again conducted intensive/extensive check on me. After 24 hours, they called me and told me that my records are clean and asked me if I need anything.....lol...

Sorry for the long description for my home work.

AsktheQuestion,

WoW, you went above and beyond to get what you needed. That is impressive. Since your record is clear, probably there will be no need for an interview and hopefully you will get to enjoy your freedom soon.

My situation was little bit different but I have been concerned..... I was on family vacation in chicago and taking pictures in downtown area with my mom and dad. 2 months later police came to meet me at my home and interviewed me, I was ofcourse very suprised with this gesture.

They had not liked the idea that we were taking the pictures and suspected the validity of the photographs. Anyways, When they saw the pics, they were convinced that it was indeed a vacation tour and I was later told that every thing is okay.

Because of that reason, I am not sure if I am in fbi databases or it could create a problem for me during name check for my I-485 processing or maybe I am just thinking too much. Any thoughts?

Thanks,
