Will H1 extension cause trouble on I-485 approval.

My I-485 RD is 9/4/2001, it is closing to end. My company lawyer want to do my H1 extension right now, although it is expired in April 2003.

My question is what if my I-485 approval come before H1 extension approval. Will that cause any trouble for me. If that is case, do I need to withdraw H1 immdediately followed by I-485 approval.

Pleae advise.

May be you should hire an immigration lawyer.

I am sure you will get your GC before the end of this year, even in the worst case scenario.

Why didn't your lawyer file for EAD? EAD works out a lot cheaper than H1 and you have more flexibility.
 
I have EAD card, but I still use H1 to work. My EAD will expire 12/2002. I will do the extension next month in local office. I expect RFE or interview for my I-485 since our company is very famous of laid off people, most colleague got RFE and interview, that why I am not opmistical about immidetely approval of I-485.

Any way, my company lawyer might want to make some money before I got GC. What should I do, should I ask them go ahead to file H1 extension and later to withdraw it once I got I-485 approval. Or should I ask them to wait for a couple month. They are saying current H1 extension take 5-6 month. I need ensure H1 extension is approved prior to my current visa expiring

My case is similar. I guess if your company is OK with filing H1 extension, then go ahead and file it. It doesn't hurt to have a H1. Also, I feel there is no need to withdraw the H1 in case your I-485 comes thru earlier. I think using your H1 to the extent possible is recommended ( unless some seniors feel otherwise).
Finally having both H1 and EAD provide total flexibility.

Another point in having H1 is that even if your GC is denied( all though very rare ) you can continue on H1 which cannot be done while on EAD....
 
Why do you want to be in a hurry

From your post, it says that your H1 is expiring in April 2003. SO what is the hurry. In fact you cannot file your H1 extension right now if the date is correct. H1 extension can only be filed 4 months in advance and that would be December. But even if you file your H1 extension upto 30 days after the h1 expiry, your status is valid. So you have pretty long time to decide. The attorney is concerned about his fees. So tell him to forget it....These attorneys are all crap. Donot listen to him and stay put. Keep you fingers crossed for your early approval of your 485 app. All the best
 
My suggestion

Wait for 1 month. If you don't get GC, file for EAD extension. It will cost you $120.

If you don't get GC by feb end, file for H1 extension.

H1 extension will cost you lot more than EAD extension.
 
I don't need pay anything for EAD and H1 renew. My company will pay for it. That is why I want to do both, just not sure the timing and consequence if I-485 approval come through before H1 extension.
