When my lawyer applied for 140/485/EAD he didnt apply for AP since my I-94 was valid till aug'05.I am planning to apply now, will this trigger 140 approval.
Any one had any experience of 140 approval this way?

Hi floridalc,

Applying for AP will shoot a hole in your pocket, but not trigger 140.

Good luck anyway.

140 ??

I agree with DIGS

I agree with DIGS.

I have send the renewal of AP(2 nd) to TSC and hoping it will trigger 140.But i was wrong in my assuption.
TSC only approved AP and still waiting for 140 approval.

Still you can try your luck and you know USCIS is strickly a FATE GAME.

I do not believe in trigger theory. But many people believe this on this forum. For Few this Happened. May be it just Coincedence or what but things worked for them.

I would say,if you really need AP then apply other wise do not waste your money and especially to this NSC. I hate this NSC. Not becuase they are not approving my GC. They are not working properly. I do not know who the head of this NSC... I just want to drag him out in front of the people and ask many questions. Well....which is not possible. Bottom line is... if you need AP,you apply and if you believe that Applying for AP will trigger then spent your money and make NSC grow.

There are high chances it would if your I 140 has been pending for a long time.
I believe in it as it has happened to me and my colleagues (our I140 were pending just over a year) and around the time they have to adjudicate the AP\EAD(i.e. 2 months after applying for EAD\AP). So your mileage may wary depening on when you filed your I140. If its more than a year old, i think it might help.

Thanks all for your responses,
I need AP anyway so i sent my documents to lawyer already.
Will let you know guys if any thing happens. My 140 is only pending for 5 months so i guess i have to stop dreaming about 140 approval in near future.

Can I apply for 7th year extension if I140 is approved

My Employer is willing to apply for 7th year extension but is it possible to do if my I140 is approved and 485 is pending.
I already got the EAD, is it better to extend H1b or can I start working on EAD, can someone please advice..

Yes you can apply for 7th H1, I heard that it can be extended for 3 yrs also, don't have more details on that..

It is always good to maintain the H1 status.. If your employer is willing DO IT.

Good luck
