Will aggravated assault charged on spouse affeect our GC process?

The cops and the local DA office can present the case in every whichever manner, thats their prerogative, but they still have to prove it in a court of law. You are the star witness, if you dont cooperate, their case will take a hit. However, IMO, they may be smart enough to know that you are likely to rescind and will probably have a backup plan. There is no way your immigration gets affected by this, your husband's is anyone's guess.
 
the fact is really one cannot do much even with 485 pending

unless I choose to withdraw it as a whole, seeing the current horrible situation after retro, thought of waiting for few months, though I have other means of getting it all over again after a few years through family as well.
I wouldn't be surprised getting the divorce papers the next day of the plastic ;)

As I said in my previous post, if the arrest happened because of one spouse calling the cops, it would be better for both of them to pack and go to any other country where they can start afresh. Everytime they are asked about the arrest here in the US, that would hurt the victim spouse as well as the complainant spouse of that sordid episode that has created havoc in their lives. So, if the spouses wanted to firm up on their married life, they need to do what is good for BOTH. Again, if both of them are courageous and are happy-go-lucky types, they can set those things aside and continue to live together here, not paying much attention to the fact that one of them got arrested. But, BOTH must be able to prefer if they want to stay here or pack and go. Even if ONE of them says, "I only love to live here," then this to me is one of the clearest sign of an impending divorce. Again, it is my personal opinion and I have seen quite a number of folks shocked to be presented with divorce papers as soon as the plastic-card arrives by mail.

My husband's case is canceled because there was not enough evidence. Now that the case being canceled, will it still impact my huusband's GC? Please suggest!

if the case got cancelled (i.e charges were dropped or dismissed), your husband's GC should be fine. For immigration purposes, they look at convictions only.

During the I-485 stage, just declare that he was arrested and attached an a general explaination of the arrest and you should be fine

I am not sure if you are still following threads. Pls help if you can:

My husband and I were arrested on charges of assault /menacing in third degree filed by NY state in 2003. Our cases were dismissed and sealed right after. We did not hire any criminal attorney. The public defendent helped. No conviction/no fine/ were fingerprinted.
Filed for I 485 and stated above in the application. What should we expect. Should we discuss with a criminal lawyer now...

well if u can try to file a petition to drop the charges, even if the charges isn't dropped this will help you in your interview. Things happen couples get mad at each other and settle their scores afterwards, so this will show USCIS that yeah things happened and u guys worked it out.

Lagtha hai, Cuircuit aur munnabhai milke aur ek film banaane ka bahuth zaroorath hai. Story hona chahiye, Indian (shayed universal who knows) male dominations of domestic voilence pe. Aur woh kitna bura hai. I am sure, lot of the crowd now a days believe in Munnabhai, circuit and gandhigiri better than the vedic books and mom preachings.

very sorry to hear the stories... from what i have learnt and seen over the years, i will tell you this...

relationship and love must be unconditional - which btw, is REALLY REALLY HARD TO FIND... trust me... I tend to think most people are opputunistic... it doent matter who is at fault.. if love doesnt workout, it is ideal to move on.. you dont have to be living together... unfortunately due to cultural differences, some families cannot do that... instead, continue hurting each other for the rest of their lives... this is really not necessary... the kids dont need that either... again, if you think, from the bottom of your heart, that you can pull it off... do try.. absolutely..

my 2 cents... Good Luck.. May love return to your lives...

I am no expert but I'd start by calling the USCIS and find out if you have Cleared the background checks. Also, consult Rajiv Khanna, Shusterman or Murthy before going all in. If you are never convicted, it may not create much trouble. Good Luck to you.
