Wife's 485 approved, primary's still pending, anyone has the same experience?

My wife's 485 was approved today and mine is still pending. I am the primary applicant. Anyone has the same experience? What shall I do now? Thank you.

Self:
I-140: RD 4/13/2004, AD 4/13/2005
I-485: RD 4/13/2005, LUD 5/13/2005

Spouse's

I-485: RD 4/13/2005, RFE issue 6/13/2005, Received 6/20/2005, LUD 6/21/2005, 6/23/2005, AD 7/12/2005

Same experience

Hi. I have the same experience at TSC.my husband who is my dependent got approved (7/8/05)but mine is still pending.
We tried to call the customer service but the lady said that there is nothing she can do about it,that it was a mistake.
My lawyer however said that the that was impossible and INS probably did not upadate my status online.My lawyer told me to wait for the written decision and if nothing happens, he will call INS in a couple of weeks.

Keep me posted.
 
Did you both apply together?

Are you in Eb3 category? I am sure if both applied together your wife's approval is on its way..provided her name-check is successfully complete.

Can you please provide details of our applications?

Indie, what is the mistake the lady at the customer service center refer to? The approval or non-approval?

I am an EB3 Sched A applicant with PD 3/16/04

The customer service rep said it was a mistake on their part to approve the derivative( my husband) first.
She said it could be revoked if reviewed by INS.The thing is, I was wondering why they cannot make an inquiry on my case instead.

So the best thing probably is to wait

Thank you. We applied together last year and I am the primary applicant. My 140 was approved on 4/13/2005, and then the LUD of both of our 485 changed to 5/13/2005. My wife received a RFE for evidence of keeping legal status since she had been in U.S. USCIS received the reponse on 6/20/2005, and then my wife's case was approved today. No LUD on my case since 5/13/2005.

We are in EB1 categary.
 
Have you tried calling the 1-800 number?Maybe you could get a different answer.
When we had our fingerprinting done, only my husband's online status was updated.We called FBI to confirm if my fingerprinting was cleared and the lady said yes.
That was the only time aside from this when we did not get the same online status.
It's really confusing.

I called the 1-800number, and it turns out to be the same message as on the website: 0n Jan. 12, fingerprint result was received.

Our online status had always been updated together until my wife received the RFE.

Please keep me posted when you receive the approval notice.

Mine is a similar case

My wife (dependent) approved however my case(primary) is pending. USCIS rep. told over phone that its possible...

Hi! We received my husband's(dependent) approval notice via mail today.
My case status online remains unchanged.

We'll see what our lawyer will say about this.

Same here. My wife received the approval notice today. I asked my lawyer and she said it is unusual that the dependent got approved before primary applicant. She also said that my case was probably approved but the online status was not updated...
 
The solution to this kind of issue would be to have the dependent go for his/her stamping at the District Office. At that time verify that the primary also has been approved. I am quite certain that is the case.

After the verification, send an expedite request to VSC to have the primary applicant's approval notice mailed out. Check out http://uscis.gov for details on how to do a expedite request. VSC should hopefully then update your case and mail out the approval letter.

I did it the expedite by fax, and within three days my status changed to approved.

Ragkb, Thank you. I read your experience in the other thread. Hopefully I will be as lucky as you. I will keep everyone updated when wife gets PP stamped.
 
PP Stamped

My wife(derivative) got her PP stamped last week. As per the District Office, my case (Primary) is still pending.

I would suggest after the derivative gets PP stamped, just query on Primary case but don't be too much aggresive on following it up further as was told by D.O. that these are rare exception cases where derivative cases get approved before primary and USCIS might again review the approved cases sometimes. So just get PP stamped and then do a cursory query on your status.

I called VSC this morning, and the lady told me that my case is pending for name check. I will send email to FBI to check out the status.
 
Primary Approved Today

Finally,it is over!Online status changed to approved for primary applicant today :D
Husband, who is my derivative received approval 3 weeks before my case was approved.
My husband went to his infopass appointment today for passport stamping ang inquired regarding my case,officer emailed TSC about this.
I got my approval at the same day!!!!
