My wife and I are going to start a business, I am a Citizen and we have filed the I130 765 485. She has an approved EAD. I currently run the business (not yet formed) and she has a full time job that she has worked for over 2 years during/before getting her EAD. She will plan to continue to work for this employer while I run the business.
I want to make her president and owner of the company for specific reasons. She also has a SSN that we have used during the application process, however, on the SSN card it says not for employment. She also has her EAD as well. should she create the company using her EAD or SSN? Will this affect her ability finish the 485? I might not be asking the right questions here either so any help you can give would be greatly appreciated. I have seen a lot of posts with both husband and wife applying and posts related to i140 etc. but never a post related to i130 765, it might just be the same thing. My main concern is to jeopardize the green card process, even though her EAD is approved.
