Gurus, please help! My wife and I submitted 485 through her company in April and got the receipt on 5/17. Unfornately she was laid off from her company at the end of May. Could you please tell me what our options are? We received AP alst weekend, but no EAD yet. If she gets a job offer, should she do a H1-H1 transfer, or should she wait for EAD? Her lawyer suggested H1-H1, but we fear that\'ll alert INS about the invalidity of our ongoing 485 case. What should we do? Your kindly help is highly appreciated.

Wife laid off after applying for 485 for one month

A good frined of mine also had the same problem, she changed from H-1 TO H-1, THE ONLY THING THE LAWYER SAID WAS SHE NEEDS TO HAVE THE SAME POSITION SO THIS NOT GOING TO BE A PROBLEM,in fact she just went for finger printing from her new H-1, the best thing will be to change to ANOTHER H-1 as fast as possible.

Guys, I am an I140 waiter and have been laid off, but my last date is set to be 2 months from now. My I140 should be getting approved very very soon. So, assuming that my I140 gets approved before my last date and I file 485 before my last date, do you think it is worth taking the chance that INS will not get to my case until 180 days after filing and by then, because of the new AC21 rule, it is already 180 days and I am safe ?
