Marriage: April 23, 2005
J1 Visa Expired: August 8, 2005
2 year HRR approved by state department August 16, 2005
2 year rule HRR waived by Vermont center January 2005
485 filing date: October 28, 2005
Fingerprint Appointment: Dec 10, 2005
Advance Parole/ I 131 approved on April 5 2006
and this is my husband's filing inofrmation:
485 labor Priority date Feb 20 2001
I140 approved on May 18, 2004
485 filing date: Sep 13 2004
Fingerprinting appointment: April 13 2005
Green Card Approved on Feb 22 2006
Husband changed his employer and within 3 weeks received his 485 approval and mailed to him.
Am I at risk getting my Green card/485 approved because I was out of status from Aug 8 till Oct 28-when my AOS was filed? (I had to wait for the J1, 2 year HRR rule to be waived before the attorney could put me as a dependent to my husband's AOS)
I have got my Advance Parole and Work Authorization card approved and in my hand.
My husband got his 485 approved in Feb 2006 and I haven't got mine so am worried.
My questions are;
1) Do I have to file any paperwork with BCIS to support my application in any way?
2) Will my being out of status for 2.5 months affect my chances of getting my green card?
3) Does the BCIS grant Advance Parole and Work authorization even if there are chances of 485 rejection? (or should I take that a s a good sign that my 485 will get approved?)
Any inputs will be appreciated.
