wife H4 problem

Hello All

My company applied for my H1 extn. and my wife H4 in September. I got my H1 approved but not my wife H4. When checked with INS they told me that my company did not pay the correct fee for H4 and that\'s why they could not process the H4. We are planning to go to India in Dec. last week or Jan. first week. Her H4 expired on November 11th. Lawyer says that it is not a problem and we can get it stamped it in India. But will it be any problem for her while returning? Can\'t we tell the Consulate that we applied before time?
Will it not be counted as overstay?
Can anybody help? I am very nervous.

Don\'t you have the reciept notice for your wife H4 application.

I cant\' understand how this came now. Basically they return the application when you applied, if correct fee is not attached.

I think it should be fine , your wife canget H4 stamp with your H1.

All along my company is telling me that INS will send H1 and H$ together.I talked to a INS officer this morning. It seems INS has wrong address. They did send the rejection letter but it was lost in mail. I never received it.
