Wife got RFE on 07/16/2004

I was approved on 07/02/2004. My wife's LUD had changed with mine on 07/02/2004, but she was not approved.

Today i got 2 emails and thought hey here come the approvals for my wife but alas "RFE issued".

I dont know what it is but think it will be for her imm. records. The only thing is that why do these guys have to wait 22 months to issue it. This is a classic example of bad management and should be documented for our case.

Now waiting for her begins all over again.

You are right. Both of your files were just sitting there for months and waiting to get second FP one day. Finally you get second FP notice and only then they decide to send RFE.

RFE possibilities:

1: Proof of current job and sponsoring employer, AC-21. Paystabs, w2, etc. Substitute labors.
2: Birth certificate: It looks like most of Indians never had a BC? We should let CIS know that this BC business is N/A (not-applicable, not-available) for now. Hopefully in the future!
3: Status in the US, too many H-1Bs, etc. Per AILA's guidance, provide only proof from LAST ENTRY into the US, based on upcoming memo.
4: Name check. USCIS is doing name checks based on form G-325 (Biographical information). Good luck here.
5: FBI's hits! More luck here.

As i have mentioned in my prior posts we were expecting our second child at the time we filed for I485, she could not have her immunization done and in fact i was always expecting an RFE for this reason, hopefully this is the reason and not any of the ones you mentioned above.

To answer some of your questions.

1. I am primary applicant and my wife is the dependent.
2. She is a HomeMaker, does not work.
3. We submitted a BC with an affidavit from our hometown (Translated)
4. Just 2 H1's (for me incl current employer)

I dont think she has any hits in Name checks, but then god only knows :)

Congratulations! :)

Tell Cheekoo that if you classfied what your wife does as "work", USCIS will deny her I485 for immigration violoation reason being working without a valid H1B. :)

Peeved .... " work " is diff than " employment ". Do you extend compensation against it ? NO ... only sweat dreams ... huh ... INS wud not issue RFE for that ... hehehe

Give guy the break..
He mentioned that she is homemaker wher he accepted what you said.
He wanted to convey that she is not enrolled employee,
hence there is less likely any name check.

That is the legal defination for a person who makes a home work. It is legally a profession. I suggest you check your vocabulary :)
 
We also used non-availability certificates and affidavits for birth certificates. Does this cause any problem? Does USCIS send RFE becuase of this?
 
It looks like if one's application has expired FP then no more processing is done on it, including primary and dependent. This is a big problem indeed. So your finger print results expired then your applications are forgotten. No processing and then you wait until and if you receive a second FP notice. When this is done, then they discover that something else is not right (RFE). What a way!

Not yet. Her LUD changed on 07/19 so i am guessing they actually mailed it on 07/19. I am expecting it to reach lawyer on friday and lawyer will take his own time so i should get it sometime next week.
