wife claimed domestic violence a few days after receiving Green Card through marriage

Hi;

My ex-wife who's from East Europe (grew up in East Germany) claimed a domestic violence a couple of days after she received her Green Card in the mail.

after she showed her clear intentions, I filed for annulity but the court issued regular divorce.

As you might know, there's a loophole in the system and many non-resident wifes claim domestic violence to exit the sham marriage and remove the condition on their temp. Green Card in order to convert it to a permanent Green Card. In the process, they don't care what happens to the poor and fool husbands who though they're married for love and not Green Card. This is very sick!

I have a question for the experts on this website on what I should do? Should I report this to INS? what should I tell them? I understand there's a slim chance that INS would deport them and charge them with immigration fraud but we need to block this loophole so other guys (and maybe some gals) don't fall victims to fraud.

Your help and advice greatly appreciaited.
 
If you want to change the law, you need to speak to congressperson / senator or formal advocacy groups (lobbyists).

I am not to advocate vindictiveness, but if you wanted to report her, you could have reported as soon as the separation proceedings started (or when you understood the motivations). Anyway, depending on when her GC was approved, you can go to CIS to challenge the removal of conditions for her GC (or revoke GC).
 
You cannot close any loophole unless you prove it to be loophole. There is a genuine reason why immigration law gives special consideration for spouse of domestic violence. But the same law can be abused (just like many regular laws, provisions).

To show that your spouse entered into marriage for sole purpose of immigration benefit, you need good evidence. Did you contest the domestic violence charge and win ? If not, everything else you do will seem like retaliation for reporting domestic violence.

If you have solid evidence that the marriage was entered into for sole purpose of immigration benefit, document the evidence, send it over to USCIS and forget about it.
