Along with my 485 i had filed for Adv Parole and EAD as a backup. But all this while I have been maintaining H1-B status so never had to use EAD/Adv parole. The EAd and Adv. parole have already expired in Nov 2003. Have not renewed them. Still on H1-B using 7th yr extension
Now I am wondering whether CIS is observing this aspect when scheduling first FP's. Would they be following a plan like
1) Has the person ever applied for an EAD?
2) If applied has the person ever used the EAD for employment. CIS can get this info from IRS.
3) the applicant has had an EAD which has expired but was it renewed.
If the answer to any of this is "NO" then they could assume that the applicant is not in desperate need for GC for employment purposes. S/he is maintaining some status(H/L) which authorizes legal employment. So the FP for this applicant can be delayed. FP's should be issued for applicants who are actively using EAD's for employment or have renewed their EAD's a couple of times. This could be an unpublished strategy and a part of their backlog reduction plan.
This is just a thought. Let us get input on the 3 questions from applicants who havent received their first FP notification yet. This might help us reveal a pattern, if there is one.
