Why NIW based I-485 are transferred to local INS centers???

I notice from various posts elsewhere that VSC is transferring I-485 (based on pre-approved NIW I-140) to local INS centers. Interviews take 8-12 months for slumbering centers like NYC.

Anybody with approved I-485 (NIW case) without interview/local transfer? What questions/documents they ask?

Was you 485 transferred too. I think only a few ctrs like hartford, baltimore do that and that too for everyone..not just the NIWs. I am in the same position as you are with NIW initially approved for CP and then I filed 485. What stage are you in right now. I guess you are from NY..arent you,

Thanks for your response. Yes, I am from NY and judging from recent VSC trends, I am 85% sure that my NIW-based I-485 would be transferred to NYC local center (the slowest one; 8-12 months for interview!). My RD is Feb/02 - so not transferred yet; but I guess VSC will touch Feb/02 cases in Jan/03 and might transfer at that time.

Mine, too, was approved for CP (even if I mentioned AOS in self-petitioned I-140) - but filed I-485 (I would have GC by now had I pursued CP!). CP to AOS also sometimes experience delays. God bless us all!!

I tried to ask this question to Attny. Murthy during this weeks chat session - but my question was not picked up. I also asked Attny. Mathew Oh (immigration-law.com) and he replied that not all NIWs are transferred but he won't be surprised if they are - because now a days concurrent filings have encouraged frivolous petitions and hence INS might have decided to give NIW-based I-485 more scrutiny. One more attorney replied to me that I-140 is automatically "over" if I-485 is denied during interview due to any reasons. Frankly, I am yet not panicked but kind of scared. I still have job fortunately that I can relate to NIW-activity, but if the case is transferred, one can't guarantee job at the time of interview amidst such a dire economy.

What's your RD? Are you too from NY? - OK, I just found ("search" I-485 forum) that you are from MD and that your RD is 07/02/02.

dates are different for many people

because a colleague of mine who filed 485 in march 2002 has his interview today (< 7 months). I guess he is either very lucky or interview dates are determined randomly. He was transferred to local office in aug. He was EB1.
 
How long we would expect for I-485 interview in Baltimore (after I-485 RD)?

Hi, guys.

It was nice to read your messages and knew the situations. Although it seems that INS is working so slowly.

I am in a boat hehind you guys. I filed I-140 (NIW) on June 6, 2002, and have got nothing feedback from INS (VSC) yet. I keep looking at their processing time update, but there is no update for processing time of November yet. (As of Oct 15, 2002, they were processing I-140 received on Feb 22, 2002. -- 4 months before my RD!).

What can I do? Only to wait, I guess. :(

But, I can not gurantee that I can keep this job (research in a University in Baltimore) long enough to catch the I-485 interview. (My boss's grant for me is ending). Maybe before that interview, I have to find another job. -- Also, I want to change to another field different than the one I file in NIW I-140. So it is a dilemma for me.

Could you please give me some clarification as to the waiting time before each phase?

1. How long one would expect to have the I-485 interview after RD of I-485? (Note: my I-485 was filed in September, 2002. So it should be considered as concurrent filing).

2. How long one would expect to get the green card after I-485 interview?

The reason that I am asking these two questions is: (1) is that possible for me to keep current job in university until I have the interview, so that I have no trouble for those NIW related questions. (2) I am eager to change a job now, but don't dare. Because the job market is not good, and the future job I am looking for is different from the field describe in my NIW.

NIW/I-485 and AC21

Can you not use the AC21 portability for approved NIW based I-140,provided your I-485 is more than 180 days pending and move to another job of similar description?Please let me know

I don't know much about that AC21 portability. But my point is that I want to change to a little different job field. This is why I was concerned about the processing time between the RD of I-485, and interview, and final approval. Because, what I am thinking here is, that I can go freely after the interview. However, if the final approval is right after the interview, there is no much sense for me!

Also, I filed NIW base on interest of public health. And this is not the labor certificate process, so there is no such a job description for this. There IS a national interest field which is for public health, and what I wrote in the letter was about medical research. But I want to explore inducstry sector. :(

Well, I guess AC21 is no use for me, and what I can do is to wait.
