Why is INS so unfair to few guys

Hi All
I have read some thread and saw some posting for folks with Rd in 2003 getting Approved, Somewhere I read that they are planning to process Concurrent cases and then go back on 2001 to July 2002 Cases.
I am really happy for our friends who are getting approved (RD from Aug 2002 onwards)
But at same time feel sad for friends who are waitimg on GC for more than 2 years after filing 485 (including me).

Is this true that folks in RD from Aug 2002 ... will be processed before Nov 2001-July 2002 cases.
I think It would be fair and good for other guys, I am happy for them, But why are they delaying our cases and adding agony to our wait.

I am really praying for everyone to get approved.
But looks like getting in game early is costing many folks than others.

I agree with you GC_KA_CHAKKAR

Some one from our side has to ask Mr.Rajiv to bring this up in next hearing. This is like calling last person in the queue ignoring the people who are at the beginning of the queue, how frustrating and confusing would it be for the people who are at the start of the queue. Same scenario here.
USCIS is neither denying nor responding to the people who filed their I485's in 2001 and 2002 and approving 2003 I485's. This is very unfair..... :mad: . We don't even know why they are not considering I485's that are filed in 2001 and 2002.
 
Yes, every dog has his day. I remember during college days I was one of those guys who would study the least & last minute, party a lot, and get away with reasonably good scores leaving others fuming. Those very same people who would slog off their butt and be angry/jealous of me then, are now well placed and doing well out here when here I am waiting endlessly for CIS to smile on me some day. So you get the picture. But I'm hoping that all this waiting and trauma will finally pay off and we can lead normal lives again.
 
Backlog Reduction Plan

Guys,

A couple of points here:
1: This is their backlog reduction plan: Process 2003 concurrent applications and leave the 2002/2001 applications in the dust.
2: Unfair, probably illegal (can be challenged in court) and real stupid.
3: Rajiv and maybe immigrationportal.org should take notes and make this a point of the complaint and litigation (data required?, beyond the few postings we have seen).
4: We should all complain to various forums, including the Ombudsman (June 30 report to Congress) at CISO@DHS.gov and Prakash.Khatri@dhs.gov. Why? Because most of these nonsense originated from his office, I think.
5: Correction: August 2002 are not being processed in VSC, except maybe a few 1st FP only ones. I am August 15 and still waiting for second FP. It looks like the ASC are processing FP s for the concurrent applicants instead!

As per my understanding (based on Memos and approvals) INS has made I485 applicants into two separate queues :
1) Those I140 is already approved (irrespective of they filed concurrently or not)
2) Those whose I140 is not yet approved (most of them are Feb'03 and later).

That's why we started seeing Feb'03 approvals. I don't understand why INS has decided to put adjudicators on people who have filed in 2003 while there a lot of people from 2001 are still waiting ? We definitely fight this out. I am going to send an Email in my personal capacity, but i am sad that we don't have enough funds with immigrationportal.org to hire some one right away to work for us and meet the INS officials. A lot of people have not yet contributed yet to immigrationportal.org. People should realize that we can really make an effective fight if we have some one to personally represent us.
I hope that we will be able to get our target fund soon.
If you have not contrubuted yet, please do so and announce it in one of the fund collection threads.
 
It's becoming clear now, from various sources, all centers are pretty much approving 03 cases leaving the 2001 and 2002 high and dry to gather more dust.

How could late 2001 to July 2002 filers have filed concurrently when there was no such choice given by the legacy INS? So instead of whining here lets become pro-active and participate in the Project Cosmos, contribute to Immigration.Org and as cinta suggested write a strong letter to Ombudsman

Nothing against those being served out-of-turn but I am tired of renewing these ancillary documents every year and getting the short end of the stick.

it sucks to gather documents once again for EAD/AP and H-1B, 8th year extension.

I read about your case being transfered to Atlanta District office, and I read from your posting that Atlanta office has long queue.
I fail to understand this logic why is INS making old guys who filled in around Nov 2001 - Aug 2002 wait till there death and approvaing all the other xases in 8-9 months.
This is so unfair, we need to highlight this Issue.

I know tufan you have been waiting for 2 1/2 years this is really frustrating

Thats what it is. I got my approval 6 months after people who approved after me got theirs. It took me more than 1.5 yrs for labor... and another person who joined the company just two weeks after they applied for my labor got an approved labor transfer from another guy who left the company. And yes... he got his GC couple of years before I did!

Its just the weird ways of fate!

But the GC always comes up. So dont worry. Its hard for most people!

As some people here have noted, this forum is a small and possibly, not 100% accurate representation, of the GC waiters. The same goes for rupnet and immigrationwatch.com.

Also, this forum has been good breading grounds for some very sensationalist news every once in a while and it really seems that there are a number of people that are prone to panic :confused:

I find it very difficult to believe that CIS will abandon 2001 and 2002 cases until the new ones are processed, in their entirety. The sample size is just too small to determine such a fact. The most likely truth is that all cases will still be processed, but the new cases will be processed faster, due to the changes in the process. I am not disputing the fairness/unfairness of this approach, just the bombshells several people here try to pass almost on a daily basis.
 
There ofcourse is a lot of sensationlism here- to be sort of expected. :eek:
In any case I don't think anyone is getting abandoned- there are always outliers- Feb'03 getting approved and Oct'01 not getting approved. But in general the trend is- the older the case- the higher the possiblity of getting approved- Rupnet and this forum would easily prove that. These forums are a very good represenation of the total population. :cool:
So you just have to bide your time and hope for the best. Meanwhile forums like this provide a good avenue for support and whining. :rolleyes:
