Why is an interview required after RFE?

Hi, folks, help please:

Here is my story.

NIW, China
PD, Nov, 1997
I485, RD, Aug, 1999
I485, ND, Sept, 1999,
FP, July, 2000,
RFE, Feb.

  In Feb, a letter from INS Vermont Center requested an employer letter
to state hire date, duties, salary and prospect for future employment.
The employer letter was sent to INS at Feb end. Last week, a transfer notice received. It say “Preliminary processing of the above application or petition has been completed, and it has been transferred to the INS office at ……, The office will notify you when they
schedule an interview ….”
        My point is, in general, if RFE is requested, an interview will not be required. But for my case, both of them were required. Is there anyone in the same situation? Please explain. Thanks.

Your case is exactly like mine: NIW PD Jan. 1998; I-485 RD July 99; ND Aug 99; FP July 2000; RFE Nov. 2000 and Case transferred to local INS in Dec 2000. Local INS asked me to do the FP again in Feb. 2001, but no interview so far. What\'s your local INS? Please let me know.

I\'m also an NIW petitioner, ND 01/00, China. One of my friends\' case was transferred to local INS(with no RFE beforehand), and she\'s done with interview. She told me the key issue during the interview was to clarify that you stayed "in the same field". Did you make this clear in your response?

Thank for concern, ABS. My local INS is Arlington Va. A little difference is your FP was after RFE and asked by local INS.

    The response letter did not explicitly state "in the same field"
because the RFE from INS did not ask for that explicitly. It asked for hire date, duties and salary ... However, the response letter implicitly answer it. The offcier can see it.

Jiansheng, did you change empolyer after filing for I-485? Also, are you self-petitioned? My lawyer also did not explicitly state "in the same field", but it was very clear from my employer letter (I changed employer after filing for I-485, but remained in the same field). I do not know whether the Adjudicating Officer paid attention to being in the SAME FIELD concept (case would have been approved, otherwise). Any way, I am planning to go the Arlington office next-week as I will be compelting the 20 month thing this week......Please keep-in-touch

ASC: I changed employer. I hired a layer. Befoere changing, I consulted my lawyer and he said it was not problem, since NIW
was sponsor free. Take care.

i received the same "preliminary ..." transfer notice by postal mail today - no RFE, nothing - I guess I have to wait for Newark to get back to me.

name. Does it influence his petition?

Jianshen & ASC, my case is same as you guys. NIW, EB2, Changed employer, stayed in same field. Since my RD is later than yours, I have not heard anygthing from INS, but I\'m expecting these RFE and Interview things to happen me too. So please post if you have something new. That will definitely help.

Hello All,

   My case is also same. EB2 ; Country - INDIA ; prospect of future employment; ND Nov 29, 1999. I changed the job and moved into the future company (that sponsored my GC) after getting my work authorization. I called VSC today and heard that my case was transferred to NY local INS office on April 2. The attorney did not receive the notice yet. Can somebody explain that all the prospect of future employment applications are sent to the local offices. I am still working in the same field.

Can somebody tell me what is NIW?
