Why BCIS should process your case within 1 year ?

Premium processing for GC / EAD/ AP

Not sure if this can be a part of the lawsuit. I did not see this issue discussed in this thread. Got the idea from elsewhere in the board.

Similar to H1 - BCIS may consider the possibility of introducing premium processing for GC/ EAD/ AP with a *firm commitment* to the processing dates.
 
Okay, here is my situation...I am with the same company that filed for my I-140 and AoS.

My first AP was valid till Sept 30, 2003. I filed for my renewal AP in the first week of July 2003. My receipt date is July 14, 2003.

During the month of August, I have renwed my H1B visa. My previous H1B was to expire by Oct 30, 2003.

During the thanksgiving holidays, my grandmother passed away. I could not even make it to her funeral. This is all because of the situation explained above.

I had to send my wife to India. My wife is still on a H4 Visa. Her H4 Visa was also renewed along with my H1B renewal. My wife had to carry nearly 4 lbs of paper work just to have her visa renewed in her passport.

Now what do you call this..What humane face about legal immigration are you talking about. I have filed for my renewals more than 90 days before the expiry of AP and EAD.

I strongly feel that BCIS should approve my AoS along with my first AP/EAD just to avoid from happening what I mentioned above.
 
Numerically, I don't think there are too many different types of hardships due to delay in I485. But if you look at each hardship vertically, it has varying degree of impact on our lives, anywhere from a simple "huh, I can live with that" to "Man, its all over for me!".

Here are some hardships gleaned from the previous postings:

1. Obstruction in career advancements in many ways. Lost opportunity, low salary, inequality at workplace etc.
2. Travel restrictions. Effects family ties, cannot freely travel outside US, effects career if it requires international travel etc.
3. Delay in Naturalization.
4. Give a feeling of temprariness in all aspects of life.
5. Problems with home loan, auto finance etc.
6. Problems with DMV as someone mentioned. This I believe will not fly as this is a DMV issue.
7. Injustice due to out of order processing.

what else....
 
premium AOS processing

INS always takes excuses such as insufficient resources. Should this issue be addressed in court? Personally I don't mind some speedup measure such as "premium AOS processing" with raised processing fee. As a matter of fact, I lost much money due to the backlog of AOS and I'd rather pay a higher fee to get it approved as soon as possible.

Many Employers know this situation and they use the immigrants ... this is 21st Century Slavery & bondage.

Another thought, should we use personal experiences / hardships like the one written by Krishnakt in the fax campaign ?
