Why AOS?

Hi,

I am curious why most of you chose AOS as opposed to CP. From my reading, most people recommend CP due to it being faster and there is (supposedly) less chance of it being denied.

I am still trying to decide between AOS and CP. The main reason I'm considering AOS is that it is *really* expensive to fly back to my home country (around $1600 per person... x2 with spouse), and I would need to gather a lot more information for CP (police clearance, birth certificates, educational docs etc).

I would much rather have my GC early... so CP would be preferred if not for the above issues.

Whats the current processing times for CP vs AOS?

Does anyone have an idea of the approval rates for CP vs AOS?

I think its the other way round. 485 is less risky than CP. There is not much your lawyers can do when you go for CP. Also due to some unexpected circumstances if your consulate closes then you get stuck. Even though 485 is slow, you have the choice of changing jobs etc after 6 months. So, even though 485 sucks people still prefer this to CP.

you may also want to consider the following,

A) Are you happy at your company?
B) Is your spouse happy with the idea of going to the U.S. consulate?
C) How close is your six years "H" status to expiring?
D) Do Department of State cutoff dates pose a special problem for you?
E) Are you willing to master the details of going to the U.S. consulate where you will be, in essence, on your own?
F) Is the salary in your labor certificate being paid to you?
G) Are you keeping an eye on your passport, and those of your family, to make sure they are valid? Do you have your and your family's old passports showing all the visas you and your family have used to enter the U.S.?
H) Might you be drafted into your country's army if you go back? Or otherwise have legal or social problems?

So... are you saying that if you file via AOS, you can change jobs?

I didn't know that was possible. What limitations are there to this?

you never heard about AC21???

yes, you could change job after filing AOS, but there are conditions, check AC21, it's on every immigration web site, maybe not the ones on MARS!!

friend, please read FAQ, visit sites like murthy.com where there is lots of good info presented in a digestable format. browse forums, make fundas - you are a smart guy.

THEN you can ask questions you know - like why us? when is INS going to pull this stick from our ass etc. Deep questions like that.

till then pertinent questions like why AOS will only rub us the wrong way!!

With CP there are some big disadvantages

- if you lose your job your CP ends immediately, with 485 you can get another job as others have mentioned

- with CP you must travel to home country , and probably at 2 weeks notice, this might be a problem for your employer to give you the time off at such short notice.

- if denied you probably cant get back to the US
