Who gets Approval Notice

Hello Everybody,
Who gets the Approval Notice, is it the lawyer and/or the I-485 applicant to his/her home address.
Thanks in advance and Happy New Year in advance too (maybe a bit too early!!)

I think you will get one copy of approval notice.
My RD(4/10/02) is close to your's. I gave the 2nd FP on 12/23/2003. When are you expecting the Approval ?

My FP was scheduled on dec 6,2003.
Gave it on Oct 31,2003 and FBI sent it to INS on the same day.

My receipt # is eac021635**** .
I am expecting approval anytime, but never know.

My ex-employer has threatned to withdraw the green card application (maybe I-140) and hence I am racing against time and hoping to get approval before he revokes.

The employer cannot withdraw the I-485, only the I-140. If 180 days have passed since the I-485 was filed, and the I-140 is approved, all USCIS will do is send a Notice of Intent to Deny.

You do have a new permanent job that can get you an EVL, right? So no worries.

Yes, I do have a job now.I-140 approved in feb 2002.
I-485 filed in April 2002.
Got laid off on May 2003.
Hopefully no worries.
Does the 'Intent to Deny' letter come to me or to the lawyer if my case goes to that extent ?

Based on your dates and the new job, you're fine. The NOID will come to the attorney, and there's one thing I will warn you about.

Unlike an RFE, for which you have 90 (or 120, I can't remember which) days to respond, you only have 30 days to respond to an NOID. Keep your eye out on the online status, and make sure the lawyer's office isn't dozy.

If you've gone 9 months after layoff without the I-140 getting revoked, I wouldn't be too worried about it happenning, but you never know.

I am also prepared for the worst from the lawyer , like not informing me etc., since he is company appointed and not by me.

Typcically you are expeted to work for sponsor for atleast 180 days before you are eligible for AC21. That is work 6 mo. after filing 485- you have not done that. However if you get laidoff rather than quit- INS looks at it favourably. But you should be aware and and be on your gaurd.

My first fp was may 17,2002 in Southern CA.
I did nothing to initiate to second fp.

I worked for the ex-employer for 1 year 1 month after the filing of I-485.

I was laid off on May 2003 (not 2002) and I-485 filed on april 2002.

There is no requirement in statute, regulation nor interpretative memorandum for the alien beneficiary to work even a single day for the original sponsor, either before or after the I-485 is filed. The August 2003 Yates memorandum clearly addresses this possibility.

You may want to do some advance planning and find an attorney that you would use in the event of an NOID.

It would be a breach of attorneys' ethics (now there's a contradiction in terms!) for the attorney to not inform you of an NOID or reply (since he is acting on YOUR behalf in the I-485 filing) but if you get an NOID and your attorney's office hasn't gotten in touch with you within ten days, you need to call your new attorney, file a G-28 and get things going.

Again, if the layoff was last May and the employer was going to withdraw the I-140 it would most likely have happened already. You probably shouldn't be worried. But this kind of preparation is like insurance or planning an escape route out of your house if it catches fire, you probably will never need to use it, but if you do you will be extremely grateful you made the effort to plan.
