Which Visa for Practical Training?

Hi,

My brother is doing MBA (International Business) in India and as one of the requiremnts of his coursework, he has to undergo practical training (internship) in a firm for 3-4 months (in India or abroad).

I talked to a firm here in US and they are ready to take him as a trainee but they have never offered this to any foreigner before so they do not know what is involved in visa processing etc.
Even my brother's school has not sent anyone to US before.

Is J-1 the right visa to apply for?

What does the school in India has to do?

I read about providing info to ISEAS by the school but the registration page looked like it was for schools in US. And what is this SEVIS and Non-SEVIS program nos?

What does the Firm in US has to do?

How do they provide the IAP-66/DS 2019 form?

I read,"To apply for an exchange visitor visa, one must present a properly prepared Form IAP-66/DS 2019 from an approved Exchange Visitor Program sponsor."

Does the firm have to become an approved Exchange Visitor Program sponsor? How is this done?

J-1 and H-1B should be two options for practical training. However, not every firm can sponsor for J-1. Mostly, government, academic/universities/medical schools, defense/military, few hotel conglomerates, non-profit organizations and private/government research labs are authorized to issue IAP-66. The company should consult an attorney or the DoS in order to understand how and whether they can get authority to issue IAP-66. Best way, in my opinion, is to try for H-1B sponsorship. J-1, anyway, might have adverse/time-consuming consequences on future immigration intentions especially if it's coined with the 2-year HRR clause.

That was a great help. Is H1-B the only option left or he can also come on B1 visa for practical training.
H1-Bs are more time and money consuming compared to B1.

B1 is for tourism only - no earning, no employment, no training, no studying are allowed. Excluding J-1, H-1B and O-1 options are left. Since your brother wants practical training, he won't be eligible for O-1. So the only option is H-1B. If you pay $1000.00 for expedited processing, H-1B is really fast that way.
