Hello,

Im having trouble in understanding something here.. thought someone might help me with this..

I moved from company A to company B last year in July. As per our stamping rules, Im not supposed to submit my new visa for stamping until 2months before it expires.. My cpy-A visa is valid until Jan05 and I was thinking of stamping my cpy-B visa somewhere in Nov04. In the meantime, 2 unfortunate stuff happened.. 1) I lost my original cpy-B visa 2) Im no longer allowed to send the visa for stamping by mail.

Now, the situation is ;

I have gone out on a cruise last month and they took my finger prints during this. I had to re-enter US with my cpy-A visa which is already stamped in my passport. Everyone says now I have overridden my cpy-B visa which was issued to me. Now, Im planning to apply for an duplicate copy of my cpy-B visa this week. Would I be still able to stamp this cpy-B visa !? I thought the intention of cancelling the stamping over mail is for the finger prints. As my finger prints have already been taken, is there a provision for me to stamp it anywhere inside the country or in Canada !?

With my situation above, do you see any problems to get my visa stamped !? Or do you suggest to apply for an entirely new cpy-B visa instead of a duplicate copy !? Im little confused with this situation here.. Please share information whichever you think will help me..

well you should not have taken the cruise till ur imigration papers were in order, you could have been denied entry if the POE officer had asked you do you still work for employer A.

Now that that is done, you would have received I-94 with the exp date on the old visa not the new one with Company B. So you will need to apply for extension of stay befoer the I-94 expires.

There is no way you can get the new visa stamped while in USA, but it is possible in Canada, using the copy of I-797 for Co.B if you have it.

USCIS takes its own sweet time to issue a duplicate copy, so dont make any plans to travel till you actually get it.
Consult a good lawyer if you get a chance.
